letter of Attorney Testat Willm Hemsley Cl Court Talbott Att S.t Maryes the Eleaventh day of Aprill one thousand six hundred seaventy eight Charles Gosfright made oath that he sawe Mathew Meriton seale signe & deliver the within mentioned letter of Attorney as his act & Deed to the use & intentions therein mentioned Proved in Common forme & sworne before mee Willm Calvert By this publick Instrument of procuration or Letter of Attorney Bee it knowne & mainfest unto all people That on the six & Twentieth day of the moneth of December Anno Domini one thousand six hundred Seaventy Seaven & in the nine & twentieth yeare of the reign of our Soveraigne Lord Charles the second by the grace of God King of England Scotland France & Ireland defender of the Faith &c Before me William Scorey Notary & Tabellion publick by authority of our Soveraigne Lord the King admitted & sworne dwelling in this Citty of London & in the p.rsence of the witnesses after named personally appeared William Turpin of Christ church parish in the County of Surrey near London Waterman & Robert Turpin of the Parish of S.t Andrew Holbourn near London aforesaid Bricklayer Legatees togeather with Symon Turpin & Jane Turpin als Marrot the wife of Henry Marrot of Walton in the County of Buckingham Sawyer menconed as Brothers & sister in & by the last will & Testament of their sister Elizabeth Moy als Turpin lately decd in Maryland in parts beyond the seas which Appeares for themselves & also for & in behalfe of their said Sister Jane from whose said Husband as well as from herselfe the said William Turpin has order & power to receive & discharge in referrence to what hereinafter menconed & also as rep.rsentatives with their said sister Jane & Intterestants with here of & in their said Brother Symon his part & share of the aforemenconed Legacies her haveing been absent for the space of Nine yeares now last past or thereabouts & they Appeares not knoweing or haveing had any News where hee is or whether hee bee liveing or dead have made or devised and in their steads & places have put constituted & by these p.rsents doe make ordaine & in their steads and places doe put & constitute M.r John Barnes of Maryland aforesaid Giving unto him full power authority & speciall charge for & in the names of them Appeares & of their said sister To aske demand & recover & receive of & from M.r Robert Carvile of S.t Maryes in Maryland aforesaid Executor of the last will & Testament of the said Elizabeth Moy decd or of his Heyres or goods wheresoever they shall bee found or of such other person or persons whom it of right doth or may concerne a Legacy of foure thousand pounds of Tobacco left as A Legacy (in & by the said Elizabeth Moyes last will unto and to be devided amongst them the said William Robert Symon & Jane Turpin or the Survivo.r of them of the recovery & receipt to make & give due acquittance & discharge And if need bee in ^&^ about the premisses or any part thereof for the Constituants to appeare & their persons in the capacity or capacities aforesaid to rep.rsents in all Courts & before all Lords Judges & Justices & to doe say pursue Implead Seize Sequester Attach arrest Imprison & to to condemne & out of prison again (when need shall be) to deliver Likewise one Attorney or more with like or limitted power under him to make & substitute & att his pleasure againe to revoake And generally in & concerning the premisses & the dependures thereof to doe say transact & accomplish all & whatsoever the said Constituants themselves acting as aforesaid might or could doe personally although the matter required more speciall authority than herein is comprized they the said Constituants hereby promiseing to have & to hold & cause to bee had & hold for good firme & of Value for ever all & whatsoever their said Attorney or his substitutes shall Lawfully doe or procure to be done in & about the premisses by Virtue of these p.rsents In wittnes whereof
