573) 583 as aforesaid and Now or late in the Tenor or occupacon of the said James Mackabey & Elizabeth his said wife or of their assignee or assignes Togeather with all Messuages Tenements or dwelling houses outhouses edifices & buildings yard gardens & orchards wayes passuages woods underwoods fences easements profitts commodities hereditaments & appurtenances whatsoever To the said tract or p.rcell of Land belonging or any wise appertaining or accepted reputed taken Demised used occupied or enjoyed as part p.rcell or member thereof or any part thereof To have and to hold the said Tract or p.rcell of Land Messuages Tenements dwelling houses outhouses edifices & buildings and all & singular other the p.rmisses above by these p.rsents Mentioned or intended to be hereby given granted aliened bargained sold enfeoffed & confirmed as afsd & every part & p.rcell thereof with the appurtenances unto the said William Harris his heires and assignes for ever And the said James Mackabey for himselfe and for Elizabeth his said wife And for theire heires execut.rs adm.rs & assignes doth covenant promise & grant to & with the said William Harris his heires Ex.rs adm.rs or and to & with every of them by these p.rsents That they the s.d James Mackabey & Elizabeth his said wife & their heires all and singular the afore mentioned to bee hereby bargained p.rmisses with the appurtenances & every part & parcell thereof unto the S.t William Harris his heires & assignes for ever and to & for his & theire owne proper use & behoofe for ever as afsd From & ag.t all & every p.rson & p.rsons whatsoever shall and will warrant and for ever defend by these p.rsents And That hee the said William Harris his heires and assignes shall & may for ever hereafter peaceably & quietly have hold possess & enjoy the afsd Tract or p.rcell of Land & p.rmisses with their & every of theire appurtenances & every part & p.rcell thereof without any lett suite trouble evi^c^tion interrupcon molestation or hinderance of or by the said James Macabey & Elizabeth his said wife or of or by theire heires or assignes or of or by any other p.rson or p.rsons whatsoever And That the said Tract or p.rcell of land and p.rmisses now are and from hence forth for ever hereafter shall remaine & bee unto the said William Harris his heires & assignes discharged & acquitted or well & sufficiently saved harmless & kept Indempnified of & from all & all manner of former & other Guifts grants bargaines sales Leases estates Mortgages Judgements executions extents statutes recognizances will intayles rents annuities fines Issues Amerciaments [illegible] orders decrees and of & from all other troubles titles charges and Incumbrances whatsoever heretofore had made done done levied suffered or Executed or hereafter to bee had made levied suffered or executed by them the said James Mackabey & Elisabeth his said wife or of or by any other p.rson or p.rsons whatsoever The rents & Services which from hence forth shall growe due & payable to the cheife Lord or Lords of the Fee or Fees onely Excepted & foreprized And further that they the said James Mackabey & Elizabeth his sd wife theire heires & assignes shall & will from time to tyme and at all tymes for ever heareafter at the request cost & charges in the law of the said William Harris his heires or assignes make doe suffer & execute and Cause |
