582 (572 This Indenture made the six & twentieth day of September in the fourth yeare of the Reigne of our Most Gracious Soveraign Lord and Lady William & Mary by the Grace of God King & Queen of England Scotland France & Ireland Defenders of the faith &c.a and in the yeare of our Lord God 1692 Betweene James Mackabey of the clifts in Calvert County in the Province of Maryland Planter & Elizabeth his wife the onely Sister & heiress of Thomas Latey late of Calvert County aforesaid Planter deceased The sonn & heire of Thomas Latey late of the same County Planter deceased of the one part and William Harris of the clifts afsd Planter of the other part Witnesseth That whereas the R.t Hon.ble Charles late Lord & Proprietary of the said Province of Maryland &c By his deed of Grant or Pattent under the his greate Seale then used in the said Province of Maryland for granting of Lands there Bearing date at the Citty of S.t Maries the Sixth day of September in the Seaventh yeare of the Dominion of the said R.t Hon.ble Charles &c.a Annoq Domini 1682 Did for the Consideration therein Mentioned Grant unto him the said Thomas Latey All that tract or parcell of Land resurveyed called Frankford S.t Michaells lyeing in Talbott County on the North Side of Choptanke river at the head of a Creeke called S.t Michaells Creeke Begining at a Marked oake standing on a poynt and runing South by west fower hundred & Sixty p.rches to a parcell of land formerly laid out for Thomas Biss called Little Bristoll and with the said Land North east Three hundred & sixty p.rches to a Marked white oake by a Swampe being abounded tree of the said Bisses land and with the said land Southeast sixty p.rches to a Branch of the afsd Creeke bounded on the North with the s.d Branch & Creeke to the first bounded tree containing & Laid out for six hundred & sixteene acres more or less Togeather with all Rights profitts benefitts & priviledges thereunto belonging (Royall Mynes excepted To have and to hold The same unto him the said Thomas Latey his heires & assignes for ever to be holden of his Lordshipp & his heires as of his Lopps Manno.r of Baltemore in fee & comon soccage By fealty onely Excepted Manner of Services under such rents covenants conditions limitations & Exceptions as in & by the said recited Deed of Grant or Pattent relation being thereunto had it doth & May more at large appear Now this Indenture further Witnesseth That the said James Mackabey & Elizabeth his sd wife for & in consideration of the full sume of Tenn thousand five hundred pounds of good sound every way well conditioned Merchantable Tobacco & caske to containe the same to them or one of them in hand well & truely paid & satisfyed by the said William Harris at or before the insealing & delivery of these p.rsents the receipt whereof they the said James Mackabey & Elizabeth his said wife doe hereby acknowledge and themselves to bee therewith wholly & fully satisfyed & paid and doe of & for every part & p.rcell thereof acquitt exonerate and discharge the said William Harris his heires Execut.rs Adm.rs & assignes and Every of them by these p.rsents have given granted aliened bargained sold enfeoffed confirmed and by these p.rsents Doe fully freely clerely and absolutely give grant alien bargaine sell enfeoffe & confirme to the said William Harris his heires & assignes All That the above Mentioned Tract or p.rcell of Land called Frankford S.t Michaell Lyeing in Talbott County afsd & buting & bounding as afsd |
