559) 569 to a bounded poplar of the said Bishops land aforemenconed the runing west south west sixty five perches to a marked red oake thence runing North north east Two hundred thirty foure perches then East north East sixty five perches thence East south East seaventy two perches thence south south west by a direct line line Two hundred and thirty four perches to the first bounded tree Conteyning & then layd out for Two hundred acres more or lesse To have and to hold the same unto the said Henry Denton his heires and assignes for ever As in and by the said two severall Letters patent relacon thereunto being severally had more plainely and at large it doth and may appeare And further whereas the sd Henry Denton and Mary his wife by their Ind.r of grannt bargaine and sale for the Consideracon therein menconed Did grannt bargaine sell alien enfeoffe and confirme unto the said Charles Calvert the aforesaid Two tracts of land with their appurtennces To have and to hold the said tracts of land to the said Charles Calvert his heires and assignes for ever which said last recited deed bearing date the second day of September A.o Dm 1690 and was acknowledged the Fourth day of the same month Before two of his Justices of the peace of Talbot County afores.d before whome they said Mary Denton the wife of the said Henry was solely and secretly Examined and declared that she past the same deed freely and voluntarily without Compulsion of her husband or any other As in and by the said recited Indenture relacon thereunto being also had more plainely and at large it doth & may appeare as also by the acknowledgement endorsed thereupon Now this Indenture further witnesseth That for and in Consideracon of the sume of twenty thousand pounds of tobacco to him the said Charles Calvert in hand payd at & before the Ensealing hereof by the said Charles Egerton The receipt whereof the said Charles Calvert doth hereby acknowledge accordingly and himselfe to be thereof and therewith fully satisfied and thereof and of every part thereof doth clearly acquite exonerate and discharge the said Charles Egerton his heires Ex.rs Adm.rs assignes and every of them for ever by these presents And for and in Consideracon of the sume of one shilling sterling to the said Henry Denton in hand also payd by the said Charles Egerton They the said Charles Calvert & Henry Denton by the direccon of the said Charles Calvert Have grannted bargained sold aliened enfeoffed and confirmed and by these presents doe fully clearly and absolutely grannt bargain sell alien enfeoffe and Confirme unto the said Charles Egerton and his heires All that the aforesaid tract or parcell of land called Seabergham Conteyning Eight hundred acres be the same more or lesse And also the aforesaid tract or parcell of land called Clowdent conteyning Two hundred and be the same more or lesse both lying in Talbot County as aforesaid And all woods underwoods timber and timber trees wayes easements proffitts Comodities and appurtennces to the said severall tracts of land belonging or in any wise apperteyning And all deeds writeings patents escripts and minuments to the same parcells of land or either of them belonging To have and to hold the aforesaid two tracts of land with all other the premisses before bargained and sold with their and each of their appurtennces unto the said Charles Egerton and his heires and assignes To the onely proper use and behoofe of the said Charles Egerton his heires and assignes for ever To be holden of the cheife Lord or Lords of the Fee or fees of the premisses by the rents and services therefore due and of right accustomed And the said Henry Denton the said two tracts of land unto the sd Charles Egerton and his heires against him the said Henry and Mary his wife and their heires shall and will warrant and for ever defend by these presents And the said Charles Calvert for him and his heires the said land and premisses unto the said Charles Egerton and his heires against him the said Charles Calvert & all clayming under him or them shall and will warrant and for ever defend by these presents And also the said Charles Calvert for himselfe his heires ex.rs adm.rs and for every of them doth covenant grannt and agree to and with the sd Charles Egerton his heires and assignes by these presents in manner & forme following (that is to say) That the said Charles Calvert & Henry Denton or one of them now are & stand or standeth lawfully rightfully and indefeisably seized of & in the said two tracts of land and premisses of a good sure perfect & indefeizable estate of inheritance in fee simple without any manner of Condicon or limitacon |
