553) 563 This Indenture made the tenth day of October in the third yeare of the Reigne of Our Soveraigne Lord and Lady King William and Queene Mary over England &c.a Annoq.r Dom 1691 Betweene William Price of Ceacil County in the Province of Maryland Gent of the one part and Nicholas Spurne of Calvert County in the Province afsd M.rchant of the other part Witnesseth That the said William Price for and in Consideracon of the sum of Fourty pounds of Lawfull mony of England to him in hand before the Ensealing and Delivery hereof well and truely satisfied and paid the receipt whereof the said William Price doth hereby acknowledge and him the said Nicholas Spourne his heires Execut.rs and Administrat.rs doth hereby of and from the Same for ever acquitt and discharge Hath given granted bargained Sold and confirmed and by these p.rsents doth give grante bargaine sell & confirme unto the said Nicholas Spourne his heires and Assignes for ever All That tract or parcell of Land commonly called or knowne by the Name of Pines Venture That is to say what is in the possession of the sd William Price being one fully halfe part or moity of the same Land scituate Lyeing and being in the County of Ceacill aforesaid and in a River of the said County and on the North side of the said River Begining at a Marked Gumn standing upon a poynt by a marsh in the said River and runing for breadeth down the said River East & by south twenty five pearches & unto a Markt Small Gumn standing upon a poynt by a cove side bounding on the said Gumn by a line drawne North & by East for Length in the woods five hundred thirty three pearches and one third part of a perch bounding on the North East by a line drawne West by North seaventy five perches bounding on the West by North by a line South by west unto the first bounded tree contayning two hundred and Fifty Acres more or less Toge^a^ther with all houses buildings barnes tobacco houses Fencing Emoluments and other the premisses thereunto belonging and to the said Tract of Land app.rteyning To have & to hold the aforesaid Moyty or halfe part of the afsd Tract of Land and other the p.rmisses hereby granted bargained & sold or meant menconed or intended to be hereby granted bargained and Sold unto hime the Said Nicholas Spourne his heires Ex.rs & Administ.rs for ever To the only proper Use and behoofe of him the said Nicholas Spourne his heires and Assignes for ever more And to noe other Use intent or purpose whatsoever And the said William Price for himselfe his heires Execut.rs & Administrat.rs doth hereby Covenant promise and grante to and with the said Nicholas Spourne his heires and Assignes That the aforesaid Moyety or Tract of Land shall be and remaine unto the said Nicholas Spourne his heires & Assignes for ever Free & Cleare of and from all Manner of incumbrances whatsoever hereby warranting and Defending the same of and from all Manner of persons whatsoever clayming or to claime any right title or interest to the Moyety or halfe part of the Land afsd And the said William Price Doth Further for himselfe his heires Ex.rs & Adm.rs Further Covenant and grant to and with the said Nicholas Spourne his heires & Assignes that he the said William Price shall & will from time to time and att all times hereafter at resonable Request and at the proper Cost and Charges of the said Nicholas Spourne his heires or assignes make such further or other assurance or Assurances of the afsd Land by way of Conveyance fine or recovery or by any other wayes or meanes for the more sure Making or Conveying the same to him the said Nicholas Sporne his heires or assignes as he or they shall be resonably advised by Councill in law In Witness whereof the said William Price have hereunto sett his hand and seale the day & yeare aforesaid his marke Sealed and Delivered in the p.rsence of us William X Price (sealed) S Watkins Endorsed on the back Barnch Williams October the 9.th 1691 Then was the within coneyance acknowledged by the Menconed W.m Price to be the Act and Deed to the Uses therein Expressed as wittness our hands the day & yeare abovesaid Hen Jowles Nicholas Greenberry |
