560 (550 This Indenture made the Nine & twentyeth day of August in the yeare of our Lord one thousand Six hundred Ninety and one Betweene Daniell Moy of S.t Maryes County in the Province of Maryland Gent and Ann his wife of the one part and Philip Lynes of the Same County M.rchant of the other part Witnessth That the said Daniell Moy and Ann his wife for and in Consideration of the sum of Thirty and Eight thousand pounds of Tobacco to them in hand paid and Secured to be paid by the said Philip Lynes at and before the ensealing and delivery of these presents Have granted aliened bargained and so^u^ld and by these presents doe grant bargaine alien and sell unto the said Philip Lynes his heires and Assignes All that the Neck of Land Lying Nearest together about Kent Fort bounding on the East West and South with Chesepiack Baÿ on the North with a lyne drawne through the woods straight Eat Begining at the Northeastermer Branch of the Creeke Called North west Creeke and ending in a Swamp on the East side of the said Neck in Chesepiack Bay conteyning and Layd out in the whole for One Thousand Acres more or less and Lyeing upon the Isle of Kent and Called by the Name of Kent Fort Manner and all Lands tenements hereditaments and appurtenances whatsoever to the same Mannor and premisses belonging or in any wise app.rteyning And all houses ediffices orchards and Gardens thereunto belonging and the Reversion & reversions remainder & remainders thereof And all rents reserved upon any Demise thereof and all the Estate right Title and interest they have unto the same togeather with all and singular Evidences pattents Leases and writtings whatsoever confering the same To have & to hold the sayd Mannor Land and premisses and every part & parcell thereof unto the said Philip Lynes his heires and Assignes for ever And the said Daniell Moy and Ann his wife doe for themselves their heires Executors and Administrat.rs covenant grant agree to and with the said Philip Lynes his heires & Assignes by these presents that the said Manner land and premisses at and before the ensealing & delivery of these presents And at all times hereafter are shall & bee & remaine free and cleere and freely and cleerly acquitted Exonerated and discharged of and from all and all Manner of other and former guifts grants bargaines Sales Joyntures Dowers Judgements Recognizances extents Mortgages troubles and Incumbrances whatsoever had done or suffered by them or either of them to any other person or persons whatsoever and The said Philip Lynes his heires & assignes shall and may from hence forth freely and quietly have hold and and Enjoy the said Manner land and premisses against all Manner of Persons whatsoever claiming by from or under them or either of them and that they the said Daniell Moy and Ann his wife the same Mannor Land & premisses and every part thereof to him the said Philip Lynes his heires & assignes forever against all Manner of persons claiming by from or under them or for ever warrant and defend by these presents And the said Daniell and Ann doe lastly further covenant and agree for them and theire heires to & with the said Philip Lynes his heires and assignes That they the sd Daniell & Ann shall and will at all tymes hereafter dureing the Space of three yeares Next ensueing doe acknowledge execute and suffer such other lawfull act or acts Deed or Deeds for the better assureing the premisses to him the said Philip Lynes his heires and assignes at the proper cost and charges of the sd Philip Lynes as by the sd Philip Lynes his heires or assignes Shall be reasonably devised or required In testimony whereof the said Daniell Moy and Ann his wife have hereunto set their hands and S^e^ales the day and year first above written Sealed and Delivered by the sd Daniell Moy (sealed) Daniell Moy & Ann his wife her mark in the presence of us Ann X Moy (sealed) Cleborne Lomax on the backe side was written thus Tho Grunwin Memorandum Tat upon the sixth day of Aprill in the yeare of our Lord 1692 Came before us two of theire Maj.ties Justices of the Provinciall Court the within Named Daniell Moy & Ann his wife and acknowledged the within written Indenture to be theire proper Acts & Deed & the sd Ann being by us |
