(56) to be Recovered and devided in manner as aforesaid as in the same statute is more fully Contayned Notwithstanding which the Eighth day of March one Thousand six hundred seventy seven Richard Windall Master or Comander of the shipp or vessell Called the Leverpoole Merchant now Rideing att Anchor in the River S.t Georges within the County of S.t Maryes in the said Province of Maryland within the Jurisdicon of this Court the said statute little Regarding nor the Paynes penaltyes & forfeitures therein fearing then and there hath imported and brought into the said Province in the said ship or vessell divers and sundry Comodityes of the growth production and manufacture of Europe which were not really and bona fide shipped or laden or taken on ^in England or Wales or the Towne of Berwick upon Tweed but were were by the said Richard Windall shiped or laden or taken in ^on^ board the said shipp or vessell in the Kingdom of Ireland that is to say Eighteene hogsheads of french wine called Clarett with severall other Europian goods a particular whereof is hereunto anexed And Alsoe the said Richard Windall master or Comander of the said ship or vessell did not upon his Entry of the said shipp with the officer appointed by the Governour for that purpose or att any ^other^ tyme since & before breaking of Bulke deliver or Cause to be delivered to the Governour or the said officer by him thereunto authorized and appointed a true and perfect inventory Invoyce or particular of the severall goods or Comodityes of the said shipp or ladeing together with the place or places in which the said goods were lade or taken into the said shipp or vessell as in and by the said statute he is Required & Enjoyned but without haveing first delivered to the Governour or the said officer by him thereunto Authorized and appointed a true & perfect inventory Invoice or particular of the severall goods or Comodityes of the said ship or vessells ladeing with the place or places in which the said goods were loaden or taken into the said ship or vessell he the said Richard Windall did then and there out of the said ship or vessell unlade divers goods & Comoditys that is to say Two hogsheads of french wine And the said Richard Windall did alsoe unlade and deliver to John Addisson and John Reddish severall Bayles Packs & Caskes of goods & other Europian Comoditys soe as aforesaid by him in the said ship imported against the forme of the statute afores.d in this Case made and Provided whereupon the said Christopher Rousby as well for the said Lord the King and the said Governour as for himselfe prayeth the advice of the Court in the Premisses And that the sayd Richard Windall Master or Comander of the said ship or vessell called the Leverpoole Marchant may forfeit the said ship or vessell with all her Guns tackle Amunition furniture and Apparell and all the said goods & Comodityes according to the forme of the statute aforesaid And that the same forfeiture be divided into Three Equall parts one Third part thereof to our Soveraign Lord the King one Third part thereof to the said Governour & the other Third part Resides of the said forfeiture to him the said Christopher according to the forme of the said statute & that the said Richard Windall may come here into Court to answer our said Soveraign Lord the King the said Governour and the said Christopher who as well for the said Lord the King and the said Governour as for himselfe in this behalfe followeth of & uppon the Premisses And upon this itt is Comanded to the said Richard Windall that all other things sett apart & all Excuses waseing he be in his Proper person before the Justices of the said Court att the Citty of Saint Maryes the Eighteenth day of March to answer the said Lord the King the said Governour and the said Christopher who as well &.ca of and upon the Premisses And further to doe and receive what the said Court shall Consider of in this behalfe under the Penalty of one hundred pounds sterling &.ca Att which day that is to say the Eighteenth day of March in the yeare aforesaid came the said Richard Windall into the Court here in his proper person to Answer the said Lord the king the said Governour and the said Christopher who as well &.ca of And upon the premisses And the said Richard by Robert Ridgely his atturney Especially admitted by the favour of the Court prayeth the hearing of the Informacon aforesaid and itt is read unto him which being Read and by him understood the said Richard Complaineth him to be by Colour of the premisses in the Informacon Specified to be grieiveously troubled & unquietted and that not justly And yet for plea to the said Informacon and as to the supposed Breaches of the Act of Parliament in the s.d Informacon menconed he the said Richard saith that he is in nothing thereof nor of any of them guilty and of this he puts himselfe upon the Country And the said Christopher who as well &.ca likewise therefore itt is Comanded the sherriff of S.t Maryes County that he cause to Come here twelve &.ca by whome &.ca who neither &.ca to Recognize &.ca Now here att this day to witt the Eighteenth day of March aforesaid came the said Christopher Rousby who as well &.ca And the said Richard Windall by Robert Ridgeley her Attorney Especially admitted by the favour of this Court And the Jurors of that Rerij likewise came to witt John Barney John Baker Thomas Innis John Doxey Edward Horne Elias Beech Richard Attwood Thomas Griffin Nicho Guither W.m Guither John Evans & John Askin who being impanelled summoned and sworne |
