531) 541 Michaell Holmes his Heires and Assignes for Ever as by the said Michaell Holmes his Heires or Assignes or his or their Councill Learned in the Law shall be Reasonably devised advised or required be it by Fine Feofment recovery Release or by Acknowledgment or Inrollement of these Presents or otherwise In Wittness whereof the parties first above Named have to these Present Indentures Interchangeably sett their Hands and seals the Day and Yeare first above written Signed Sealed & Delivered Geo Hawes (sealed in the Presence of Us with the words (any person whatsoever) in the sixteenth line interlined Tho Clasett Ant Und.rwood Philip Lynes W.m Nickolls John Mudge 10 sds Articles of Agreement Indented Concluded & Agreed upon between George Hawes of Calvert County in the Province of Maryland Merchant of the one part and Michaell Holmes of the City of London in the Kingdome of England Mariner of the other part as followeth Imprimis That whereas the above Named George Hawes by a Certaine Indenture of sale under the Hand and seal of the said George Hawes Dated the 25.th Day of May 1688 did for the Consideracons therein menconed fully Clearly and Absolutely Grant Bargaine Sell Aliene Enfeoffe & Confirme unto him the said Michaell Holmes & his Heires all that one Moiety or halfe part of a Tract pcell or dividend of Land Called Letchworth's Chance lying in Calvert County &c as by the aforesaid Indenture Relacon being thereunto had it doth may more at large appeare 2.dly That whereas the abovesaid Tract or divide^n^d of Land Called Letchworths Chance was at the Ensealing & delivery of the abovesaid Indenture undevided & parted between the said Geo Hawes & Michaell Holmes & to the intent to prevent all future Controversies & difference that may accrue or arrise by the meanes thereof the said George Hawes & Michaell Holmes have Consented & Agreed that Edward Batson Deputy surveyo.r of the said County should Run out the whole Tract or dividend of Land above mencond & Equally to devide the same by a Line Begining at the midle of the west Line (being the southermost bounds of the said Land & Running North untill it meet with the East Line of the said Land (& the Northermost bounds thereof) 3.dly That whereas the abovesaid Tract or dividend of Land was by the said Edward Batson run out & devided as abovesaid the said George Hawes for himselfe his Heires & Assignes doth hereby Conclude and agree to & with the said Michaell Holmes his Heires & Assignes to be therewith fully sattisfied and Contented |
