5 Given Granted Bargained Sould Aliened Enfeoffed & Confirmed And by these p.rsents doe cleerly & absolutely Give Grant Bargaine Sell Alien Enfeoffe & Confirm unto the said Charles Boteler his heyres & Assignes All that parcell or part of land lying att the head of Sassafrax River called by the name of Daleys Desire containing & laid out for five hundred acres more or lesse now in the [illegible] occupacon of Alexander Younger & Sarah his now wife or of their Assigne or Assignes under tenant or under tenants And all manner of houses Edifices buildings trees wayes passages woods & underwoods pastures feeding [illegible] comon of pasture loatens ditches fislieings fences rents Easem.ts profitts [illegible] & Appurtenances whatsoever to the said parcell or tract of land & all & singular the said p.rmisses belonging or any ways apperteyning or accepted reputed [illegible] demised used occupyed or enjoyed as part parcell or member thereof or any part thereof And the Reversion & Reversions Remainder & Remainders thereof every part & parcell thereof And all the Estate Right title Interest use possession possibility clayme & demand whatsoever of them the said Alexander Younger & Sarah his now wife & either of them of in or to the said parcell or tract of land [illegible] part & parcell thereof & p.rmisses before menconed to be hereby Given Granted Bargained Sould Enfeoffed & Confirmed with the Appurtenances [illegible] Patents Evidences Conveyances Writings & minum.ts concerning the said [illegible] only or only any part thereof To have & to hold the said parcell or tract of Land & all & singular other the p.rmisses above by these p.rsents menconed to be Given Granted Bargained Sould Enfeoffed & Confirmed as aforesaid & every part or parcell thereof with the Appurtenances unto the said Charles Boteler his Heyres & Assignes To the only proper use & behoofe of the said Charles Boteler his Heyres & Assignes for ever And the said Alexander Younger & Sarah his now wife for themselves & either of them their & either of their heyres Exec.rs & Admest.rs [illegible] them doe hereby joyntly & severally Covenant promise & Grant to & with the said Charles Boteler his heyres & Assignes in manner & forme following that say that they the said Alexander Younger & Sarah his now wife or one of them at the tyme of the Ensealing & delivery of these p.rsents is & standeth lawfully seized & in the said parcell or tract of land & other the p.rmisses above menconed to be hereby Given Granted Bargained Sold Aliened Enfeoffed & Confirmed aforesaid & every part & parcell thereof with the appurtenances of a good right full & Absolute & Indefeazible Estate of Inheritance in Fee Simple without any [illegible] Mortgage or lymitacon which may any wayes alter change defeate or [illegible] the same And also that they the said Alexander Younger & Sarah his now wife have in themselves or one of them hath now att the tyme of the Ensealing and delivery of these p.rsents full power good right & lawfull Authority to Give Grant Bargaine Sell Alien Enfeoffe & Confirme the same to the said Charles Boteler his heyres & Assignes in manner & forme aforesaid and according to his true intent & meaning before Expresses And also that the said Charles Boteler his heyres & Assignes & every of them shall & may from tyme to tyme & at all tymes for ever hereafter peaceably & quietly have hold use occupy possesse & [illegible] said parcell or tract of land & p.rmisses above menconed to be hereby Given Granted Bargained Sould Aliened Enfeoffed & Confirmed as [illegible] |
