446 (436 off the aforesaid Deed to the within Named Richard Stevens bearing Date the teenth Daÿ of October anno Domini 1684 Untill then seized of the said Land and pmisses w.th the appurtenances thereunto belonging of a firme sure good and indefeazeable Estate of In heritance in fee simple in the said Land and that theÿ have good right full power & Lawfull authoritÿ to grant Bargaine & sell the same to him the said Richard Stevens & that they will for Ever Warrant & Defend the same to him the said Richard Stevens his heires or assignes for Ever against all psons whatsoever Claiming from by or under the said Thomas Pemberton & Elizabeth his wife their heires or assignes and all & Every the heires of the said Elizabeth and the said Thomas Pemberton and Elizabeth his wife for them selves & their heires Doe further Covenant Grant and agree to and w.th the said Richard Stevens his heires and assignes that theÿ the said Thomas Pemberton and Elizabeth his wife & their & Either off their heires of the said Elizabeth shall & will att anÿ time hereafter for & Dureing the space of five ÿeares Next Ensueing the date hereof att & upon the reasonable request & only att the Cost & Charges in the Law of the said Richard Stevens make Doe and acknowledge Execute & suffer or Cause to be Made Done acknowledged & suffered all and Everÿ further & other act & acts thing & things device & devices whatsoever in the Law to be done for the better setling and more pfect sure Making of all & Everÿ the bargained pmisses unto him the said Richard Stevens his heires & assignes for Ever as shall Be by him the said Richard Stevens his heires or assignes or his or their Councill Learned in the Law reasonably devized advised or requiered In Confirmation and full assurance of the truth above written The said Thomas Pemberton and Elizabeth his wife have to this psent sett to their hands and fixed their seales given deed & state with full & peaceable possession by Liverÿ of seizin of & in y.e above mentioned Land & pmissed w.th the appurtenances thereunto belonging as the said Thomas Pemberton and Elizabeth his wife their subscripcons fixeing of their seales & the wittnesses subscripcons as testimonÿs doe Manifest the Daÿ & ÿeare first above written signed sealed & delivered by the Tho Pemberton (sealed said Thomas Pemberton in the presence of Elizabeth Pemberton (sealed W.m Clark Cl John Road On the Back side of the afore receited deed was Endorssed Memorandum that this day to witt the 19.th of the Eight month Called October anno Dim 1685 Thomas Pemberton & Elizabeth his wife Came before us W.m Clark and John Roades two of the Members of the Provincill Council for the province of Penselvania & the territaries thereunto belonging and the said Elizabeth being by us |
