435) 445 One whole ÿeares Rent and since vizt on the Ninth Daÿ of octob.r annoq.r Domini 1684 the said Thomas Pemberton & Elizabeth his wife did bÿ their Certaine Deed of Indenture duely Executed & Enrolled alienate Make over and Confirme the above said Nine hundred acres of Land Fairefeild to the within Named Richard Stevens as records makes appeare recourse being thereunto had in Somersett County in the Province of Marÿland aforesaid Libe M A folio 625 and whereas the bounds in the former Deed of the above said Nine hundred acres of Land Called Fairefeild was Not Exactlÿ Mentioned Wee the said Thomas Pemberton & Elizabeth being by the said Deed bound to Make further assurance of the said Land if thereunto required Within seaven Yeares to the Within Named Richard Stevens therefore This Indenture further Wittnesseth that the above Named Thomas Pemberton & Elizabeth his wife doth acknowledge ourselves to bee fully & whollÿ satisfied & paid his Wife for & in Consideration of twenty thousand pounds of tobacco in hand paid by the Within Named Richard Stevens before the Ensealing & Deliverÿ of the former deed bearing Date the Ninth daÿ of October Annoq.r Domini 1684 wherewith wee the said Thomas Pemberton & Elizabeth his Wife doth acknowledge our selves to bee fullÿ & wholly satisfied & paid & Doth & for Every part & parcell thereof acquitt & discharge the said Richard Stevens his heires Ex.rs & adm.rs for Ever and by this present Indenture have Given granted bargained sold Enfeoffed & Confirmed And doe by These presents Give Grant bargaine sell Enfeoffe & Confirme unto the said Richard Stevens his heires and assignes for Ever all that tract parcell or Devident of Land afore mentioned Called fairefeild Containing Nine hundred Acres of Land More or Lesse scituated Lyeing & being as aforesaid together with all the Rights proffits Priviledges & Benefitts thereunto Belonging (Royall Mines Excepted) as alsoe all & singular the roomes sellers sollars Parlours Chambers houses Courts housings ÿards gardens orchards Closses fences Woods Underwoods timber or timber Like trees and other hereditaments Emoluments and appurtenances whatsoever unto the said Parcell of Land & premisses Together with all & singular Letters pattents Exemplifications of fines & Recoveries Chirographies of fines Charters deeds Indentures whatsoever unto the said parcell of Land and premisses or anÿ of them appurtenant Belonging or appertaineing or had used demised or Enjoyed as part parcell or Member thereof or as thereunto or to anÿ part thereof belonging or appertaining To have & to hold the said Nine hundred Acres of Land Called fairefield With all and singular other the premisses herebÿ Mentioned to be bargained and sold & Every of them unto him the said Richard Stevens his heires & assignes to the only proper use & behoofe of him the said Richard Stevens his heires and assignes for Ever without anÿ Mortgage redempcon use or Limitacon to recall alter charges or determine the same the rents and services due to the Lord & Lords of the Fee allwaies Excepted & foreprized and the said Thomas Pemberton and Elizabeth his wife for themselves their heires Ex.rs & adm.rs doe for Ever freelÿ acquitt & discharge the same of & from all & all Manner of former & other bargains grants sales forfeitures Dowaries Jointures surrenders & off & from all other titles Incumbrances Claimes & demands whatsoever and was att the time of Ensealing & delivery of |
