407 (398 off the said Land the said James Cullen is hindred and obstructed in the seale off the said Land by reason off y.e sd W.m Boarman in the right off Mary his wife Late Marÿ Jarbo Layes Clayme to an Equitab.l right to y.e sd Land by vertue of a Certaine Deed thereoff made by y.e sd Marke Cordea in his Life time to y.e sd Marÿ Jarbo now wife off y.e sd W.m Boarman as aforesaid w.ch Deed was Never Legally Executed in retardacon off y.e Execution off y.e will off y.e sd Marke Cordea and the said James Cullen for y.e Ending all Controverses touching the said Boarmans Claÿme to y.e sd Land or any other parte off y.e state off y.e sd Marke Cordea & to y.e End hee May y.e better proceed in y.e sale off y.e sd Land made & given y.e sd W.m Boarman good sufficient security for paym.t off y.e sume off thirty & five pounds off Lawfull Mony off England for all his y.e sd W.m Boarman and Marÿ his wife their right title and Interest or or to any parte or pcell of y.e reall or psonall estate off y.e sd Marke Cordea deceased Now iff y.e sd W.m Boareman and Marÿ his wife their heÿres Execut.rs and administrators doe before the tenth day off Aprill Next Ensueing the Date hereoff make or Cause To be made and Execut.d unto the above named Henry Darnall his heires & assignes such good & sufficient Conveyance and assurance in y.e Lawe off all their right title and Interest off in or to y.e sd Land Called Markes place or any part thereoff w.th warranty only against themselves their heÿres and Assignes and all Clayming by from or under them Either or any off them w.th other Necessary Covenant as by y.e sd Henrÿ Darnall his heÿres or assignes or his or their Councell shal bee reasonably devised advised or required and the same Deed shall aknowledge to be inrolled or recorded according to Lawe and shall alsoe deliver upp or Cause to be delivered upp To y.e sd Henry Darnall his heÿres or assignes the said Deed made by y.e sd Marke Cordea to y.e sd Marÿ Jarbo as afsd Thatt then this psent obligaon to bee voyd and off Noe Effect or Else to stand in full force power & vertue sealed and delivered in W.m Boareman sealed psence off Ro Carvile Kenelme Cheseldyn To all Christian people to whom these psents shall Come Robert Brooke off Calvert County in y.e province of Maryland in parts beyond the seas sendeth Greeting & Whereas I the said Robert Brookes did by mÿ Letter of attorneÿ under My hand & seal bearing date the twentieth ninth daÿ off August in the first year off the Raigne off our soveraing Lord James The second by the grace off God off England Scotland France & Ireland King deffender off the faith &c annoq.r Domni One Thousant six hundred sixty Eightÿ five Constitute and appoint Henrÿ Darnall of Putaxent in Calvert Countÿ aforsaid Esq.r Mÿ father in Lawe my true and Lawfull Attornÿ for me and to my use benefitt and behoofe to sell & Dispose off all and Everÿ mÿ houshold Goods & other Goods Moveable and Immoveable off whatt Nature kind or qualitÿ soever the same be as well those ^then^ in ^the^ Custody or keepeing off the said Henrÿ Darnall as in the Custodÿ or keeping off anÿ other person or persons in Marÿland aforesaÿd and for the best & most marteable rates & prices the same might be sold for as Likewise for me & in mÿ Name and to mÿ use to aske demand receive all such Debts Dutyes sume and sumes of Monÿ Goods Merchandizes and other Paÿements whatt soever as were due & owinge or off right ought to be paid to me The said Robert Brooke by anÿ person or persons whatsoever in Marÿland aforesaid and uppon Receipt or payement off the same or off anÿ part or pcell thereoff acquittances or other Legall Discharges to make seal & deliver as to my said Attornÿ should seeme meet And I did therebÿ alsoe further constitute and appoint mÿ said attornÿ for me and in mÿ name to contract & agree |
