397) 406 off the said Henry Darnall his heyres and assignes for Ever and to Noe other Intent use or purpose Whatsoever In testimony Whereoff the said James Cullen hath hereinto sett his hand and seale the seaventh day off March in the Year off our Lord one thousand six hundred Eighty & six sealed and delivered In y.e James Cullen (sealed) presence off R.t Carvile Daniell Langhorne his John J Whitehead marke On y.e backe side off y.e afore receited Deed Was Endorsed as followeth viz.t March y.e 7.th 1686 Acknowledged in Open Court by the within Named James Cullen to be by him signed sealed and as his act & deed delivered Came into Co.rt Kenelme Cheseldyn atto.r off Antho Wood off Liverpoole in the County off Lankaster in y.e Kingdom off England Iron monger and acknowledged taken Received off y.e honorab Coll Henry Darnall y.e full summe off sixty five Pounds ster Money off England for y.e use off y.e sd Wood w.ch sd sume off 65.ll ster is in full satisfaction for a Certaine tract off Land Lyeing in Calvert County Called or knowne by the Name off S.t Markes place w.ch sd tract off Land was Lyable to an Extent by Reason off a Judgem obteyned by y.e sd Wood against marke Cordea upon a statute Merchant and y.e sd Kenelme sheseldyn by vertue of y.e power to him given given for and In Consideracon off y.e sd 65 pounds ster doth remitt & release the said react off Land Called S.t Markes place from all Extents that may accrue to y.e sd Anth Wood by reason off y.e Judgem afsd by him obteyned Came Kenelme shelseldyn atto.r off Major W.m Boarman & Marÿ his Wife & Delivered a Certaine deed by Marke Cordea to y.e sd Mary made where in he gave to y.e sd Marÿ a Certaine Tract of Land Cont Eleaven hundred acres Called S.t Marks place To bee Cancelled & made void to all Intents & purposes in Law Mariland Know all men by these presents Thatt I William Boarman off y.e County off S.t Maryes in y.e province off Marÿland Getle doe acknowledge my selfe to owe and stand indebted unto Henry Darnall off y.e same County Esq.r in y.e full and Just sume off two hundred pounds off Law full Mony off England to be paid to y.e sd Henry Darnall or to his certaine attorney his Execut.rs administrators or assignes to y.e w.ch payem well and truely to be made I bind my selfe my heires Execut.rs and administrators in the and for y.e whole firmely by these psents sealed w.th mÿ seal and dated the twenty fourth day off feb Annoq Domin 1686/7 The Condition of This obligation is such that where as Marke Cordea Late off y.e said County Gentle deceased did by his Last will & testament under his hand and seal bearing date the twenty seventh day off March 1685 amongst other things therein Conteyned give and bequeath to his Executors thereaffter named all thatt tract or pcell off Land called Markes place Containing Eleaven hundred acres Lyeing in Putoxant River to be by them sold towards y.e payem off his debts and Legacÿs and off y.e sd will he did make and ordein his Loving wife Esther Cordea since alsoe Deceased and James Cullen Executors and Wheras the sd Henry Darnall hath Contracted with y.e sd James Cullen the surviveing Executor for y.e purchase OFF |
