369) 378 To all Christian people to whome these p.rsents shall come wee Nicholas Sewall of Calvert County in the Province of Maryland Esq.r Henry Darnall of the same County Esq.r & William Digges of S.t Maryes County Esq.r send greeting in our Lord God Ever lasting whereas att a Court of Admiralty held by speciall Comission att the house of Richard Keen in Petuxant River in the said County of Calvert the nine & Twentyeth day of August last past before the Justices thereunto assigned a certain Information was Exhibitted by the said Nicholas Sewall then Collector to his most Sacred Maj.tie James the second of England Scotl.d France & Ireland King Defendour of the Faith &c of all the Rates dutyes and Impositions due and payable to his said Maj.tie in the said Province of Maryland who aswell for our said Soveraign Lord the Kings Maj.tie that now is and the Right Hon.ble the Lord Prop.ry Cheif Governour of the said Province as for himself p.rsecuted against James Scott Ma.r & Comander of the Ship Albercorne of London Derry in the Kingdome of of Ireland for breach of the Act of Parliam.t for Encouragm.t of Trade made in the fifteenth year of the Raigne of our Late soveraigne Lord King Charles the second of blessed memory deceased the Justices of the said Court did the day and yeare aforesaid att Petuxant River aforesaid adjudge & Condemne the said ship with all her Gunns Tackle Amunition Furniture and Apparell & all European goods to be lost & forfeited for the breach of the Law aforesaid to be divided according to the Law aforesaid into three Equall parts That is to say one Third part thereof to our said Soveraigne Lord the Kings Maj.tie that now is one Third part to the said Lord Prop.ry Cheif Governour aforesaid and the other third part to the said Nicholas Sewall who aswell for our said Soveraigne Lord the king and the said Lord Prop.ry as for himself prosecuted as aforesaid And wheras the said Ship was by Comission from the said Court Appraised to the sum of one hundred and Fifty pounds of Lawfull money of England Know Yee that Wee for and in Consideration of the sum of one hundred and Fifty pounds of Lawfull money of England to us in hand before the Ensealing and Delivery thereof truly paid by Ninian Beal & Thomas Brookes of the said County of Calvert Gent of which sum we doe acknowledge the Receipt by these p.rsents That is to say I the said Nicholas Sewall for the use of his most Sacred Maj.tie the King that now is have reced the sum of Fifty po.ds lawfull money of England for his said Maj.ties Third part for the shipp Gunns Tackle amunition furniture and apparell aforesaid And wee y.e said Henry Darnall & William Digges other Fifty pounds for the said Lord Prop.ry Cheif Governour his Third part And I the said Nicholas Sewall the other Third part according to the true intent and meaning of the Statute aforesaid Have bargained and sold and by these p.rsents doe bargain & sell unto the said Ninian Beal & Thomas Brookes the said Ship called the Albercorne of London Derry and All & singular the Gunns Tackle Amunition Furniture & Apparell to the said Ship belonging or Appertayning or to or which the said Ship now used or occupyed To have and to hold the said ship and all and singular the Gunns Tackle Amunition Furniture And Apparell aforesaid to them the said Ninian Beal & Thomas Brookes their Exe.rs Admistra.rs & Assignes to and for their only proper use and behoof for Ever In Testimony whereof we have hereunto sett our hands and seales the nine & Twentyeth day |
