343) 352 the Contrary) now hath in himselfe full power & lawfull & absolute authority to grannt bargaine sell and assigne the said mannor plantacons houses landes tenements hereditaments goods Chattells and all & every the premisses herein before menconed or intended to be hereby bargained and sold or assigned (except before excepted) In mannor & forme aforesaid And that it shall & may be lawfull to & for the said Thomas Plowden & George Plowden their heires executors adm.rs & assignes respectively from time to time & at all times hereafter peaceably & quietly have hold occupy possesse & Enjoy the said Mannor plantacons Messuages houses lands tenements hereditaments goods Chells and premisses aswell reall as personall & every part & parcell thereof (except before excepted) And the rents issues & proffits thereof to have & to be to his and their respective use and uses according to the true intent & meaning of these presents and of the said Ind.r bearing date the eighteenth day of September 1679 without any lawfull let suite trouble denyall hindrance molestacon or Eviccon of or by the said Richard Pery his heires or assignes or any person or persons lawfully having or clayming or to have or clayme by from for or under him them or any of them And that free and cleare and freely and clearly acquitted Exonerated & discharged of & from all & all manner of former & other guifts grannts bargaines sales Leases estates joyntures dowers uses wills intayles titles troubles charges & Encumbrances whatsoever had made comitted done or suffered or to be had made comitted done or suffered by the said Richard Pery his heires or assignes or any other person or persons lawfully having or clayming or to have or clayme by from for or under him them or any or either of them (Except as herein before is menconed to be excepted) And further That he the said Richard Pery his heires executors & adm.rs and all & every other person & persons whatsoever lawfully having or clayming or to have or clayme by from or under them or any of them (Except as aforesaid) shall & will from time to time and at all times hereafter within the space of Tenn yeares now next ensuing upon the reasonable request and at the costs & charges in the law of the said Thomas Plowden & George Plowden their heires executors & assignes or some of them make doe acknowledge suffer & Execute All & every such further & other lawfull & reasonable Act & Acts desire & desires Letters of Attorney powers authorities conveyances & assureances in the law of the said Three whatsoever for the further better or other conveying setling or assureing of the said Mannor plantacons Messuages houses lands tenements hereditaments goods Chells and premisses aswell reall as personall hereby bargained sold assigned & set over & every part & parcell thereof (Except before excepted) in manner & forme aforesaid & according to the true intent & meaning of these presents as in that behalfe shall be reasonably devised or advised and required soe as noe such further Act device or assureance conteyne or imploy any larger Covenants then herein are conteyned and soe as noe such person or persons who shall be required to make doe or suffer any such further Act devise or assureance be hereby compelled or compellable for the making doeing or suffering the same to travell or goe further then to the Cityes of London & Westminster or one of them or above five miles from their then respective habitacons And the said Thomas Plowden & George Plowden for them & either of them their & either of their heires ex.rs & adm.rs doe Coven.t grannt & agree to & with the said Richard Pery his heires executors & adm.rs by these presents That they the said Thomas Plowden & George Plowden their heires executors adm.rs or some of them shall & will from time to time and at ll times hereafter well & truely observe performe stand to & keepe att the Covenants & agreements in the said recited Ind.r conteyned on the part & behalfe of the said Richard Pery his heires executors & adm.rs to be observed & pformed Except as hereafter is excepted And well & sufficiently save defend keepe harmeles & indempnified him the said Richard Perry his heires ex.rs & adm.rs & every of them & his their & every of their lands & tenements goods & Chattells of from & against all & singuler the Covenants grannts articles Clauses & agreements in the said Ind.r bearing date the s.d 18.th day of Septemb 1679 conteyned |
