34 This Indenture made the Two & Twentyeth day of June in the second yeare of the Dominion of Charles Absolute Lord & Proprietary of the Provinces of Maryland and Avalon Lord Barron of Baltemore &c Anno Domi 1677 Betweene William Calvert of Calvert Rest in S.t Maryes County Esq.r of the one part & Robert Mason of the same County aforesaid of the other part Witnesseth That the said William Calvert Esq.r for & in Consideration of Two Thousand pounds of Good Tobacco in Caske to him in hand before the sealing & Delivery hereof by the said Robert Mason the Receipt whereof the said William Calvert doth hereby Acknowledge & himselfe therewith full Satisfied Contented & paid & thereof & of Every part & parcell thereof doth hereby Absolutely & Clearly Exonerate Acquit & Discharge the said Robert Mason his heires Exec.rs Adm.rs & Assignes for Ever By these p.rsents hath Given Granted Bargained Aliened Sold Enfeoffed & Confirmed & by these p.rsents doth fully Clearly & Absolutely Give Grant Bargaine Sell Alien Enfeoffe & Confirme unto him the said Robert Mason his heyres & Assignes for Ever All that parcell or Tract of Land Scituated Lyeing & being upon the North side of the Maine Branch of Deepe Creeke in S.t Michaells Hundred in the aforesaid County being bounded as followes (viz.t) From A Marked white Oake on the North side of the Maine Branch of Deepe Creeke aforesaid Running North West One hundred and Fourteene perches to A Marked Pickhickery From thence South West & by West Sixty Nine Perches to A Marked white Oake From thence South East & by South sixty three perches to A Marked Redd Oake upon the head of the aforementioned Branch of Deepe Creeke from thence Ninety Nine Perchers East Downe the said Branch unto the first Mentioned Oake Contayneing & now laid Out for fifty Acres of Land more or Lesse Together with all & Singuler the Rights & Benefitts thereunto belonging or any wise Concerning the premisses or any part or parcell of them with all houses Edefices buildings Orchards & Gardens whatsoever thereunto belonging with all & Singular the Rights Members Jurisdictions Priveledges Profitts or Benefitts appertayneing or belonging thereunto To have & to hold the said Tract or parcell of Land and att the singular Bargained Premisses unto him the said Robert Mason his heires & Assignes for Ever And the said William Calvert for himselfe his heires Exec.rs & Adm.rs Doth hereby Covenant and Grant to and with the said Robert Mason his heires & Assignes that he the said William Calvert his heires Exec.rs & Adm.rs the said Tract of Land & all other the Bargained premisses unto him the said Robert Mason his heyres & Assignes against all manner of psonn or persons whatsoever Claimeing by from or under him them & Every of them shall & will for Ever hereafter warrant and defend him the said Robert Mason his heyres & Assignes Yeilding & payeing therefore yearly unto the said William Calvert his heyres Exec.rs or Adm.rs att the Mansion house of the said William Calvert in Calvert Rest att or upon the the tenth day of November Five Bushell of Good Indian Corne Two Poultry & one barrell of Corne for heriott And in Case the said yearly Rent be behind & unpaid tenn dayes after the said time of payment That then itt may & shall be lawfull to and for the said William Calvert his heyres Exec.rs Adm.rs or Assignes to Distrayne upon the premisses & for want of A sufficient Distresse there to be had to Reenter and the same to hold and Enjoy as his or theire former Estate and furthermore the said Robert Mason shall doe secure to the Court of the said William Calvert his heyres & other aforesaid att his or theire Mannor aforesaid as often as itt shall be Kept there att or upon Reasonable Sumons or warning In Witnesse whereof the partyes to these p.rsents have hereunto interchangeably Sett theire hands & fixed theire seales the day & yeare above written &c Signed Sealed & Delivered in p.rsence of Will Calvert Sealed Nic Painter Jn.o Fawkes On the back of the Above Deed was Endorsed (viz.t) Memorandum that on the Three & twentyeth day of June in the second yeare of the Dominion of Charles Lord Baltemore &c Over Maryland Annoq Domi One Thousand six hundred Seaventy Seaven before Us Philip Calvert Esq.r & Baker Brooke Esq.r Two of his Lordpps Justices of the Provinciall Court Came W.m Calvert Esq.r within named & Acknowledged the within Written Indenture to be his Act & Deed & alsoe Elizabeth Wife to the said W.m gave her free Consent to the sale of the within Mentioned Land & premisses & Acknowledged that she did itt without the Compulsion of the said W.m Philip Calvert Baker Brooke |
