309) 318 Testes Kenelm Cheseldyn December 3.d 1684 Robee R N Addison Then Richard Thompson made oath before Me that he saw Robert Crossman of Liverpoole Richard Thompson signe seale and deliver this Instrument unto Randolph Hinson as his act and deed Will Hatten Decemb 3 1634 Then Came Richard Benton of S.t Marys County and desired that the marke of his hoggs and Cattle might be recorded which is as follow viz.t A Flower deluce on the left Eare and Cropt and under keeled on the right Eare By this Publick Instrument of Procuracon or Letter of Attorney Bee itt knowne & Manifest unto all those who shall see these p.rsents or heare the same Read That on the Twentieth day of the month of September Anno Dom 1684 And in the Six & Thirtieth yeare of the Reigne of our Sovereigne Lord Charles the second by the Grace of God King of England Scotland France & Ireland Defender of the faith &c Before mee Nicholas Hayward Notary & Tabellion Publicke Dwelling in London by Authority of his said Majesty admitted & sworne And in the presence of the witnesses hereafter named personally Appeared Samuell Heathcoate of Derby in the County of Derby gent att p.rsent in London Heire att Law to Nathaniell Heathcoate his uncle of West River in Anne Arrund.ll County in the Province of Maryland gent Deced Who hath made ordained Constituted Deputed & Appointed as by theise p.rsents in his Stead & place hee doth make ordaine Constitute Depute & appoint his Loving Brother Joseph Heathcoate of West River aforesaid planter his true & Lawfull Attorney Giving and by theise p.rsents granting unto his said Attorney full power & Lawfull Authority for him Constituant and in his name and to his use to bargaine sell grant & Confirme to any person or persons att such rate or price either in money goods or Tobaccos and upon such Termes & Condiccons as the said Attorney shall finde Convenient for the Constituants most profitt & Advantage All that Tract or parcell of Land scituate in West River aforesaid which was late the Plantacon of the said Nathan.ll Heathcoate being by Computation Five Hundred acres or thereabouts As alsoe another Tract of Land scituate in Gunnpowder River Containeing by Computation Five Hundred acres or thereabouts togeather with another Tract or parcell of Land att the head of South River in Anne Arrundell County aforesaid Containeing Two Hu^n^dred acres or thereabouts And all other parcell or parcells of Land of the said Samuell Heathcoate in the said Province of Maryland Which were late the Inherritance of the said Nathaniell Heathcoate with all & singuler houses buildings Edifices Materialls goods Chattles & things whatsoever as shall bee found to belong or any wise appertaine to the said Tracts of Land either or any of them And if need bee in the name of the said Constituant to enter into and upon the said Tracts of Land Plantacons & all and singuler other the p.rmisses the p.rsent Possesso.r or Possesso.rs from thence to expell & Remove And to give possession thereof to the Purchaser or Purchasers To demand & Receive the price & valew for which the sid Plantacons Lands & p.rmisses shall bee sold & every parte thereof upon Receipt to give Acquittance and Discharge The said Constituant further granting unto the said Joseph Heathcoate his Attorney full power & Authority to seale Deliver & execute in due forme to the use of the buyer or Purchasers such Deeds of bargaine & Sale writeings & Conveyances of the said Lands Plantacons & other the p.rmisses as shall bee needfull & Convenient for the Peacable enjoyment of the p.rmisses to the Purchaser or Purchasers theire Heires & Assignes forever And generally to doe & performe any other matter or thing whatsoever which shall bee Reasonable & neccessary without Limitation or Reservation as fully & amply to all intents & purposes as her Constituant himselfe might or Could doe if personally p.rsent and to render an acco.t of the produce of all the p.rmisses to the said Constituant who promiseth to hold for firme valid & Irrevocable all & whatsoever his said Attorney shall Lawfully doe or cause to bee donne in & about the p.rmisses by vertue of theise p.rsents In witnesse whereof hee hath heereunto putt his hand & seale in London the Day & yeare aforesaid Sealed & delivered in the p.rsence of Sam Heathcoate (S) Samuell Phillips In Testimonium Veritatis signo meo manuali solito signari James Till &c Tabellionat mei Sigill apponi rogatus George Phillipp Nic Hayward Not Publ |
