301 (292 This Indenture made the fifth day of March in the Nineth year of the Dominion of the Rtt Hono.ble Charles absolute Lord and Prop.ry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c and in the year of our Lord God One Thousand six hundred Eighty and Three Between Nicholas Nicholson of Anarrundale County Marchant and Hester his wife of the one part and Gilles Yallopp of the City of London in the Kingdome of England Marchant and Now Resident in the said Province of Maryland of the other part Wittnesseth that whereas the said Rtt Hono.ble Charles absolute Lord and Proprietary &c by his Letters pattents under the great seale of the said Province of Maryland bearing date at the City of S.t Maryes the Eighteen day of May in the Fourth year of the Dominion of the said Rtt Hono.ble Charles absolute Lord and Prop.ry &c and in the year of our Lord god one Thousand six hundred seaventy and Nine for and in Consideration in the same mentioned did Grant unto the said Hester by the name of Hester Gough All that parcell of Land called Widdower Lott Lyeing in Ceicill County in the North side of susquehanock River begining at a marked Red oake standing on a high Bank and Runing from thence East North East one hundred pearches to a marked Hickery and from thence bounded on the North by a lyne drawen East foure hundred and forty pearches and from thence Bounded on the East by a lyne drawen South East and by South two hundred & seaventy perches and from thence bounded on the south by a lyne drawne West to a marked oake standing by the River Five hundred fourty five perches and from thence Bounded on the West with the River with a lyne drawne Norwest and by North to the first Bounded Tree Two hundred and forty perches Conteining and then layed out for Eight hundred acres more or Less Together with all Rights proffites and benifites thereunto belonging (Royall Mynes Excepted) To have and to hold the same unto the said Hester Gough her heires and assignes for Ever to be holden of his Lopp and his heires as of his Lopps Mannor of Ceicill in free and Comon Soccage by fealty onely for all manner of services under such Rents Covenants Conditions Limitations and Exceptiones armand by the said Recited Deed of Grant or pattent Relation being thereunto had it doth and may more at Large appeare Now this Indenture further wittnesseth that the said Nicholas Nicholson and Hester his wife for and in Consideration of the sume of Fourty pounds of good and Lawfull mony of England to them or one of them in hand well and truly paied and secured to be well and truely paied by the said Giles Yallopp att or before the Ensealing and delivery of these presents the Receipt whereof the said Nicholas Nicholson and Hester his wife do hereby acknowledge and themselves therewith fully Contented satisfied and paied And thereof and Every part thereof do Clearly acquitt Exonerat and discharge the said Giles Yallopp his heires Exers Administrators and assigness by these presents Have given granted Aliend bargained sold Enfeoffed and Confirmed and by these presents do fully freely Cleerly and absolutely Give grant alien bargain sell Enfeoffe and Confirme unto the said Giles Yallopp his heires and assigness for Ever All that the abovementioned parcell of Land called widdows Lott Containing Eighty hundred acres of Land more or Less and now in the tenor or occupation of the said Nicholas Nicholson or of his assignee or assigness Together with all Rights profites and benifites to the same parcell of Land belonging or in any waie appertaining with thappurtenances and all and singular Timber and Timber trees wayes passages woods and underwoods fences Rents Easments Comodetyes hereditaments and appurtenances whatsoever to the said parcell of Land belonging or in any waies appertaining or accepted Reputted taken delivred used occupied or Enjoyed as part parcell or Member thereof and the Reversion and Reversions Remainder and Remainders Issues and proffites whatsoever of all and singular the said parcell of Land to be hereby bargained premisses with theire and Every of their apurtenances and Every part and parcell thereof and all and singular the Estate or Estates Right title use Intrest possession Rent property Inheretance Clame and demand whatsoever of them the said Nicholas Nicholson and Hester his wife of in or to the aforementioned to be hereby bargained premisses with their and Every of their apurtenances or any part thereof Together with all deeds writtings pattents Evidences Chirographys fines Exemplifications of Recoverys Boundaryes and minuments whatsoever touching or Concerning the said parcell of Land and premisses or any part or parcell thereof To have and to hold the said parcell of Land and all and singular other the said premise before mentioned or Intended to be given granted aliened bargained sold Enfeoffed and Confirmed with their and Every of theire appurtenances and Every part and parcell thereof unto the said Giles Yallopp his heires and assignes for Ever to and for the onely proper use and behoofe of him the said Giles Yallopp his heires and assigness for Ever And the said Nicholas Nicholson and Hester his wife for themselves their heires Executors Administrators and assignes and for Every of them doth Covenant promise and Grant to & with the said Giles Yallopp his heires Execu.rs Adm.rs and assigness and to and with Every of them by these presents that they the said Nicholas Nicholson and Hester his wife their heires Exer.s adm.rs and assigness |
