246) 256 in the Province of Maryland Merchant and Elizabeth his now wife the daughter of Hugh Kinsey late of the Province of Maryland and in the County of Ann Arundell deceased of the one part And William Cromwell of Baltemore County in the Province of Maryland Planter of the other part Witnesseth that whereas the Right Honoble Cæcilius of most noble memory late absolute Lord and Prop.ry of the said Provinces of Maryland and Avalon &c By the Deed of grant or Patent under the great seale then used in the said Province of Maryland for granting of lands there bearing date att St Marys the Thirteenth day of February in the Eight and twentyeth year of the Dominion of the said Right Honoble Cecillius &c Annoq.r Dm One thousand six hundred Fifty Nine Did for the Consideracon therein menconed grant unto the above named Hugh Kinsey a parcell of land called Kinsey lyeing on the west side of Chesepeake bay and on the South side of a River in the said Bay called Patapsco River about Nine Miles from the Mouth of the River Begining att a marked Oake standing neer a poynt of Marsh runing North north west up the River for breadth two hundred perches to a marked Cedar tree by a Marsh side bounding on the north by a line drawne west from the said Cedar for length Three hundred and Twenty perches on the west by a line South South east from the end of the West line Two hundred perches on the South by a line drawne East from the end of the South east line unto the first marked Oake on the East with the said River Containing and then layd out for Four hundred Acres more or lesse Together with all profitts Rights and benefitts thereunto belonging Royall Mines excepted To have and to hold the same unto him the said Hugh Kensey his heires and Assignes for ever To bee holden of the Lopp and his heires as of his Manno.r of Baltemore in Free and Comon Soccage by fealty only for all manner of services under such Rents Covenants Condicons limitacons and exceptions as in and by the said recited Deed of grant or Patent Relacon being thereunto had more att large it doth and may appeare And whereas also the said Hugh Kinsey being soe thereof seized made his last will and Testam.t in writeing bearing date the sixth day of May in the yeare One thousand six hundred Sixty seaven And thereby amongst other things therein contained Did bequeath give and possess Elizabeth Kensey his youngest Daughter w.th All his whole estate both moveables and moveables as well his then dwelling Plantacon as other goods to be assigned given and delivered according to law and according to the desire att the time in the said last will and Testam.t menconed to her and her heires for ever (except as in the said will is excepted) as by the said last will and Testam.t of the said Hugh Kensey relacon being thereunto had more at large it doth and may appeare Now this Indenture further witnesseth that they the said Richard Johns and Elizabeth his said wife for and in Consideracon may well condiconed Merchantable Tobacco and Casq.r to containe the same to them or One of them well and truely payd and secured to be payd by the said William Crowell att and before the ensealing & delivery of these p.rsents The receipt whereof they the said Richard Johns and Elizabeth his wife doe hereby acknowledge and themselves therewith fully satisfied and payd and thereof and every part thereof doe clearly acquitt exonerate and discharge y.e said William Cromwell his heires Exec.rs Adm.rs and Assignes and every of them by these p.rsents Have given granted aliened bargained sold enfeoffed and Confirmed And by these (p.rsents |
