23 This Indenture made the Twenty Eight day of November in the First yeare of the Dominion of Charles &c Absolute Lord Proprietary of Maryland and Avalon Lord Barron of Baltemore And in the Yeare of Our Lord One Thousand Six hundred Seaventy and Six Betweene Joanna Farrier of the Herring Creek in S.t Maryes County in the Said Province Widow of the One part & John Evans of the Same place planter of the other part Witnesseth that the said Johanna Farrier for and in Consideracon of the Sume of Five Thousand & five hundred pounds of Good Sound tobacco in Caske to her in hand payd att and before the Ensealing and Delivery of these p.rsents by the Said John Evans well and truly payd whereof the Said Johanna Farrier doe Acknowledge the Receipt And of Every parte and parcell thereof doth Clearly Acquitt and discharge the Said John Evans his heyres and Assignes and Every of them for Ever by these p.rsents have Given Granted Bargained Sould infeoffed & Confirmed by these p.rsents unto the Said John Evans his heyres and Assignes for Ever All the plantacon or Tract of Land Scituate Lyeing & Being upon the herring Creeke in Potomack River Comonly Called and Knowne by the name of Hogg Neck bounding upon the South with the Said Creeke on the East with the Land of Robert Kager On the West with the Land of Thomas Bushell On the North with A line drawne East from A Marked Tree in A Swampe next Bushells Land Called James Swampe untill it meete with the said Kagers Land Conteyning and then laid Out for One hundred Acres of Land more or lesse And now in the Tennor & Occupacon of the said Johanna Farrier Together with all and singular the houses buildings Orchards hereditaments and appurtenances whatsoever to the said plantacon or Tract of land now or heretofore belonging and Every part and parcell thereof To have and to Hold the Said Plantation or Tract of Land and all and singuler the premisses with theire appurtenances before by these p.rsents Bargained and Sold or meant to be hereby Granted Bargained and sold and Every part and parcell thereof unto the said John Evans his heyres and Assignes to the only proper Use and behoofe of him the Said John Evans his heyres and Assignes for Ever And the Said Johanna Farrier her heyres Exec.rs Adm.rs and Every of them Doe Covenant promise and Grant to and with the Said John Evans his heyres Exec.rs Adm.rs and Assignes by these p.rsents that the said Plantacon or Tract of land and all other the p.rmisses above by these p.rsents Menconed to be Granted and Sold and Every part and parcell thereof on the date of the date thereof and from time to time and att all times hereafter for Ever shall be remaine and Continue to the Said John Evans his heyres and Assignes to the only proper use & behoofe of him the said John Evans his heyres and Assignes for Ever Free and Clearly Acquitted Exonerated and Discharged or otherwise by the said Johanna Farrier her heyres and Assignes sufficiently saved and Kept harmlesse of and from all manner of Former Bargaines sales and of and from all manner of other Charges Titles Troubles and Incumbrances whatsoever had made Comitted suffered or done by the said Johanna Farrier her heires and Assignes That the said John Evans his heyres and Assignes shall and may from henceforth for Ever peaceably and Quietly have hould use Occupy possess and Enjoy the said Plantacon or Tract of land houses and buildings and Orchards and other the premisses above by these p.rsents Menconed to be bargained and sold And the said Johanna Farrier Shall and will from time to time and att all times hereafter dureing the Time and space of Seaven Yeares upon Every Reasonable Request and att the Cost in the Law of him the said John Evans his heires or Assignes Doe make Acknowledge Execute and Suffer or Cause to be made Done all such other lawfull Act or Acts Conveyance of the premisses be itt Fine Feeoffment inrollment of the p.rmisses or any other Manner of lawfull wayes whatsoever for the Better and sure makeing of the p.rmisses to the said John Evans his heyres and Assignes for Ever As by the said John Evans his heyres or Assignes or his or theire Councell learned in the law shall be reasonably devised or Required In Testimony Whereof the said Johanna Farrier have hereunto putt her hand & seale the day and yeare above Written Signed Sealed and Delivered the Marke in y.e p.rsence of Us Johanna I Farrier Sealed Thomas Evans Jonathan Clarke of On the Backside of the Above Menconed Deed was Endorsed (viz.t) Quiett possession of the p.rmisses within Mentioned was Given by Johanna Farrier and Taken by John Evans in the p.rsence of Us Thomas Evans Jonathan Clarke Aprill the Seaventeenth One Thousand Six hundred Seaventy Seaven The ^within^ Written Deed was by the within named Johanna Farrier Acknowledged in Open Court to y.e Uses therein Specified Jn.o Blomfeild Cl Cur Provin |
