216) 226 lyeing and being in Calvert County aforesaid on the west side of Pautuxen River nere pon the Freshes Begining att a marked Oake neare a Byte or Branch and runing North up the River for breadth one hundred and Fifty perches unto the bound tree of James Berrys land bounding on the North with a line drawne west from the said Tree for the length of Three hundred and Twenty perches on the west with a line drawne south from the end of the west line for the length of One hundred and Fifty perches on the South with a line drawne East from the end of the south line unto the first marked Oake on the East with the said River Containing Two hundred Acres more or lesse (Excepting and reserving unto Hannah the late wife of John Potts aforesaid deceased the one third part of the same lands dureing her naturall life) Together with all rights profitts benefitts advantages and appurtenances whatsoever thereunto belonging To have and to hold the said lands (except before excepted) and all other the p.rmisses hereby granted bargained sold or intended to be granted bargained and sold and every part and parcell thereof with all and singular their and every of their appurtenances unto the said Ninian Beale his heires and Assignes for Ever to the only proper use and behoofe of him the said Ninian Beale his heires and Assignes for Ever And the said Isaac Foxcroft and Bridgett his wife for themselves their heires Executo.rs and Administato.rs and every of them doe Covenant promise and grannt to and w.th the said Ninian Beale his heires Executo.rs and Assignes and every of them by these p.rsents in manner and forme following viz.t That hee the said Isaac Foxcroft in his owne ^right & to his owne^ use now is and standeth lawfully seized of a good perfect and absolute Estate in law in Fee simple off and in the said parcells of lands and other the p.rmisses with their Appurtenances and that hee hath a ^good &^ lawfull Right and authority to bargaine sell and assure the same unto the said Ninian Beale his heires and Assignes for Ever according to the true meaning of these p.rsents And that his said land and other the p.rmisses with their Appurtences now are and for Ever hereafter shalbee and Continue cleare and free discharged and acquitted or otherwise att all times saved harmelesse by the said Isaac Foxcroft and Bridgett his wife their heires Executo.rs and Administrato.rs oft and from all and singular former Grannts bargaines sales Estates Bonds Statutes Intrusions Dowers Titles of Dower Joyntures rents Arrearages of Rents and other charges and Incumbrances whatsoever had made or done or to be had made or done by or from the said Isaac Foxcroft or Bridgett his wife or by any other person or persons claiming by from or under them or either of them or by their or either of their means or procurement And the said Isaac Foxcroft and Bridgett his wife their Executo.rs and Administrato.rs will warrant and defend the same (except before Excepted) unto the said Ninian Beale his heires and Assignes for Ever against Thomas Eyres and Jane his wife of the Collony of Virginia aforesaid their heires Executo.rs and Administrato.rs and Assignes and all other person or persons whatsoever And further that they the said Isaac Foxcroft and Bridgett his (wife |
