217 (208 By This publick Instrument of Procuracon or Letter of Attorny Bee it knowne and manifest unto all those who shall see these p.rsents or hear the same read That on the Thirtyeth day of the month of August Anno Dm One thousand six hundred & Eighty And in the two & thirtyeth year of the Raigne of our soveraigne Lord Charles the second by the Grace of God King of England Scotland France & Ireland Defender of the Faith &c Before me Nicholas Hayward Notary & Tabellion publick dwelling in London by authority of his said majestie admitted & sworne And in the p.rsence of the Witnesses hereafter named Personally appeared M.r Georg Gosfright of London Merchant (to me the said Notary well knowne) who hath made ordeined and Constituted as by these p.rsents in his stead & place hee doth make ordeine & Constitute Thomas Tasker of Puttuxen River in Maryland Merchant his true & lawfull Attorney Giveing and by these p.rsents granting unto his said Attorny full power and lawfull authority for him Constituant and in the name and to his use to aske demand sue for lievy recover and receive of the Heires Exec.rs or Admstrs of late William Gough of Puttuxen River planter or merchant deceased or of any person or persons whome of right it doth or may Concerne all such Tobaccoes goods wares merchandices or Effects as are due oweing belonging or appertaining unto the said Georg Gosfright the Constituant as well on accompt of goods consigned unto the said late William Gough as otherwise for what cause or reason soever And the said Attorny is hereby impowered to receive into his possession all goods which remaine unsold and the produce & proceed of those disposed of and to require a true & inst accompt of all trade & dealings between the Constituant and the said late William Gough And the said Accompts to adjust & ballance Alsoe to Compound Conclude agree & determine any difference upon Recoverys and receipts to give Acquittances Releases & discharges in due forme And if need be to appear and the person of the said Constituant to represent in any Court or Courts & before all Lords Judges & Justices thereto answer defend & reply in all matters & causes touching or Concerning the p.rmisses to doe say sue implead arrest seize sequester attach imprison & to Condemn & out of Prison againe to deliver And generally to use all lawfull wayes & meanes for the Recovery thereof either by course of law or otherwise as fully & amply to all intents & purposes as he Constituant himselfe might or could doe if personally p.rsent With power to substitute one or more Attornys & the same againe to revoke Hee Constituant promiseing to hold for firme & valid all & whatsoever his said Attorny or his substitutes shall lawfully doe or cause to be done in & about the p.rmisses by Vertue of these p.rsents In witness whereof the said Constituant hath hereunto putt his hand & seale the day & year first above written George Gosfreight (sealed) Sealed & delivered In testimonium Veritatis signo meo manuli solito signavi in the pnce of Et Tabellionat mei sigillum apposui rogatus Philip Lynes Porten Paul (sealed) Nic Hayward No.rius Publis 1680 |
