193 184 Reciprocally bound the one to the other in the sume or penalty of Five hundred pounds sterling a peece To stand to and abide observe obey fullfill & keep the finall Award Judgm.t and determinacon of us the said Thomas Tailler and William Stevens Arbitrato.rs indifferently chosen by and between the said Charles Lord Baltemore for and on the behalfe of himselfe and the said John Browne for and on the behalfe of his said Samuel Shrimpton for and concerning all and all manner of differences or matters of controversy that have ever been made or arrisen by and between the said Charles Lord Baltemore & Samuell Shrimpton for or by reason of any goods heretofore sent and consigned or p.rtended to bee sent and consigned by the said Samuell Shrimpton in Copartnership between him and James Browne late of this Province decd sonne of the said John Browne The said Arbitracon to be made & given up & delivered to the said Charles Lord Baltemore & John Browne within fourteen days after the date of the said Bonds As in and by the said bonds and Condicons relacon hereunto being and may more plainly and att large appeare Now Know yee that wee the said Arbitrato.rs haveing posed all papers Oaths and accompts to us by both partys produced And considered of the Allegacons on both sides Doe find that the said Samuel Shrimpton and James Browne were concerned in Copartnership together to the vallue of Twenty three thousand six hundred Forty Nine pounds of Tobacco The moytie whereof wee doe adjudge to be belonging to the said Samuel Shrimpton which debt appears to be left in bills in the hands of William Tolson of Cæcill County in this Province And also that there was in Copartnership between them a pcell of Pewter to the value of sixty three pounds Fourteen shillings and Three pence three farthings New England money the one moytie whereof belonging alsoe to the said Samuell Shrimpton and find noe more in partnership between them the said James Browne and Samuell Shrimpton And therefore wee doe make and declare this our Award and finall determinacon of and upon the p.rmisses in manner & forme following (that is to say) First wee Award order and adjudge That the said Charles Lord Baltemore on or before the Two and twentyeth day of March next ensuing the date hereof shall pay or cause to be paid unto the said John Browne for the use of the said Samuell Shrimpton The one moytie of such tobacco as he the said Lord Baltemore hath already received by vertue of some of the bills left in the hands of the aforesaid Tolson which appears by accompt of and in the hands of the said Lord Baltemore And also shall deliver to the said John Browne for the use aforesaid the moytie of the remainder of the bills menconed to be left in the hands of the said Tolson upon Equallity both as to the sume and creditt of the pson indebted And if what formerly received by vertue of the said bills and the moytie of the bills remaining shall not amount to the sume of Eleaven thousand Eight hundred twenty four pounds and a halfe pounds of Tobacco that then ^the^ Said Charles Lord Baltemore shall pay soe much Tobacco more as will cause the same to amount to that sume Item wee Award order & adjudge that the said Charles Lord Baltemore shall within the time aforesaid or on the day aforesaid pay or cause to be payd in lieu of the said moytie of the said Pewter unto the said John Browne for the use of the said Sam.ll Shrimpton his Exec.rs Adm.rs or Assignes the sume of Thirty one pounds Seaventeen shillings |
