183 192 Maryland fs Know all men by these p.rsents That I John Browne of Salem in New England Merchant am held and firmely bound unto the Right Hono.ble Charles Lord Baltemore in the full and just smme of Five hundred ^pounds^ of lawfull currant mony of England To be paid to the said Charles Lord Baltemore his heires Executo.rs admistrato.rs or assignes To the which payment well and truely to be made I bind my selfe my heires Executo.rs & Admstrs firmely by these p.rsents In witness whereof I have hereunto sett my hand and seale the one and twentyeth day of February Anno Dm One thousand six hundred and Eighty Whereas the above bounden John Browne on the behalfe of Samuel Shrimpton of Boston in new England to whome he is Attorny and the above named Charles Lord Baltemore for himself Have agreed to stand to and abide the Judgm.t award and small determinacon of Lieu.t Coll Thomas Tailler and Coll William Stevens Arbitrato.rs indifferently chosen by and between the above said John Browne in behalfe of the said Samuell Shrimpton and the above named Charles Lord Baltemore on his owne part and behalfe for and concerning all and all manner of difference and matter of controvsie that have ever been had made or arisen by and between the said Charles Lord Baltemore and Samuel Shrimpton aforesaid for or by reason of any goods heretofore sent & consigned or p.rtended to be sent and consigned by the said Samuell Shrimpton in Copartnership between him and James Browne late of this Province deceased sonne of the above said John Browne and whereas the said Charles Lord Baltemore and John Browne have mutually elected & made choyce of Coll Vincent Lowe (In case the said Arbitrato.rs shall not consent and agree to compose the difference and controvsie aforesaid) For their Umpire finally to conclude determine and compose the same Now the Condicon of this Obligacon is such That if the said Samuel Shrimpton his heirs Executo.rs and Adm.rs shall well and truely stand to abide observe obey fullfill & keep the finall award Arbitram.t judgm.t and determinacon of the said Arbitrato.rs (in case any shalbe by them made) or of the said Umpire in case the said Arbitrato.rs shall not agree To be made and putt in writing under the hands and seales of his said Arbitrato.rs or y.e Umpire aforesaid indented & ready to be delivered unto the said Charles Lord Baltemore or his Assigns and to the said John Browne on behalfe of the said Samuel Shrimpton w.thin Fourteen dayes after the date of the above written obligacon But in case the said Arbitrato.rs shall not agree as aforesaid The said Umpirage to be made and given up as aforesaid within one and twenty dayes after the date of the above written obligacon Then the obligacon to be voyd and of none effect or else to stand and abide in full force and vertue John Browne (sealed Sealed and delivered in the p.rsence of John Llewellin Tho Grunwin To all people to whome this p.rsent writing of Award indented shall come Coll Thomas Tailler and Coll William Stevens send greeting whereas by bonds of Arbitracon bearing date the one and twentieth day of this instant month of February The Right Hono.ble Charles Lord Baltemore for himself and on his owne part and behalfe and John Browne of Salem in New England Merchant as Attorny and for me on the behalfe of Samuel Shrimpton of Boston in New England became reciprocally |
