191 (182 By This publick Instrum.t of Procuracon or letter of Attorny be if knowne & manifest unto all People That on the twentyeth day of the month of July Anno Dm 1680 English stile Before me W.m Storey Notary and Tabellion publick by authority of our soveraigne Lord the King admitted and sworne dwelling in the City of London and in the p.rsence of his Witnesses afternamed psonally appeared William Rousby of London aforesaid Merchant unto me Notary well knowne And hath made ordeyned and his stead and place both putt and constituted and by these p.rsents doth make ordeyne and in his place and stead doth putt and constitute Christopher Rousby of Maryland in part beyond the stead Merchant the true and lawfull Attorney Giveing unto him full power authority & speciall charge For and in the name and to the use of him constituant to aske demand sue for recover and receive of and from Thomas Bowdell of Maryland aforesaid Planter or of his heires Executo.rs Adm.rs or goods or such others whome it doth or may concerne all and singular such sume and sums of mony Tobaccoes Effects and things whatsoever as the said Thomas Bowdell doth owe and is indebted to the said Constituant Bee the same by Booke obligacon speciality accompt or otherwise nothing excepted nor reserved with all Costs damages and interests Allsoe to accompt with the said Thomas Bowdell and to receive what due by Ballance And (if need soe require to Compound and agree And any thing in difference to submitt unto and determine by way of Arbitracon Of the recoveryes and receipts to make and give due acquittance and discharge And (if necessary) for the said Constituant to appeare & his person to represent in all Courts and before all Lords Judges and Justices and to doe say pursue implead seize sequester attach arrest imprison and to condemne and out of Prison againe (when need shalbe) to deliver Cum facultate substituendi And generally in & concerning the p.rmisses whatsoever the said Constituant himself might or could doe personally Although the matter required more speciall authority then herein is comprized The said Constituant hereby promiseing to have hold also to ratifie and confirme for good and of vallue forever all and whatsoever his said Attorney or his substitutes shall lawfully doe or procure to be done in & about the p.rmisses by vertue of these p.rsence of mee Notary and of Thomas Brookhouse and Porten Paul Witnesses W Rousby (sealed Tho Brookhouse Porten Paul In testimonium veritatis manu mea solita signavi ac sigillo corroboravi Guil Scorey Not.rius Pubcus 1680 Know all men by these p.rsents that I Christopher Rousby have by Vertue of the Letter of Attorny within menconed reced of Thomas Bowdell in the letter of Attorny named the Twenty third day of Novemb 1680 for the use and behoofe of y.e w.thin named William Rousby the Constituant the bill obligatory bearing even date with these p.rsents signed sealed & delivered by the said Thomas to the use of the said William whereby the said Thomas Bowdell doth oblige himself his Heires Exec.rs & Adm.rs to pay to the said William Rousby his Exec.rs and Adm.rs or certaine Attorney the full sume of Fifty pounds sterl money of England which Fifty pounds I the said Christopher Rousby Attorny or Procurator of the said William Rousby doe hereby make knowne & declare is in full of all Debts accompts & demands whatsoever due from the said Thomas Bowdell to the said William Rousby from the begining of the world untill the time of the sealing & delivery of the said bill by the said Thomas to the use of the said William as aforesaid In testimony whereof I have hereunto sett my hand and seale the day and yeare above said Signed Sealed & delivered before us Tho Taylor Chr Rousby (sealed Jo Rousby |
