18 day of September One Thousand Six hundred Seaventy Six in the p.rsence of Nicholas Hayward Notary and Tabellion Publick dwelling in London aforesaid and divers other sufficient Witnesses and by the said Notary duly attested by affixing thereunto his seale of office hath sufficiently Empowered the said Thomas to Confirme the said Land and premisses to the said Daniell Moy sonne & heyre of the said Richard Moy deceased as by the Same Letter of Attorney Remaing upon Record in the Secretaryes office in the Said Province of Maryland in the Provinciall Booke Marked W C Folio Eleaven As by the Same relation being thereunto had more Fully & more at large It doth and may appeare Now This Indenture Further Witnesseth that the said Thomas Taylor for and in Consideration of the Sume of One hundred twenty five pounds Sterling money to him in hand paid before the Ensealing and Delivery of these p.rsents the Receipt whereof ^he^ the Said Thomas doth hereby Acknowledge And thereof and of Every part and parcell thereof doth Clearly and Absolutely acquitt Exonerate and discharge him the Said Daniell Moy his Exec.rs and Adm.rs by these p.rsents hath Given granted bargained aliened and Sould and by these p.rsents doth Give Grant bargayne alien and sell unto the Said Daniell Moy his heyres and Assignes for Ever All that parcell of land Called the Vineyard aforesaid according to the Meetes and Bounds before Expressed Conteyning as aforesaid by Estimacon in the Whole Three hundred & Forty Three Acres or thereabouts with all and Every the lands Tenements Rights Members or appurtenances to the Said parcell of land belonging or in any wise apperteyning together with all the Deeds Evidences Patents Grants Charters Escripts writeings and Minuments whatsoever of or Concerning the Same To have and to Hold the Said land and premisses to the only proper Use and Behoofe of him the Said Daniell Moy his heyres and Assignes for Ever And the Said Thomas Taylor doth hereby for and on the behalfe of the Said George White his heyres Exec.rs and Adm.rs and alsoe for and on the behalfe of himselfe his heyres Exec.rs and Adm.rs Covenant and Agree to and with the Said Daniell Moy his heyres Exec.rs Adm.rs and Assignes That he the said George White att the time of the Ensealing and Delivery of these p.rsents is and Standeth Seized of the Said Lands and Premisses with theire appurtenances of A firme Sure Good and indefeasable Estate of Inheritance in Fee Simple And that he the said Thomas Taylor att the Ensealing and delivery of these p.rsents hath Good Right full Power & lawfull Authority to Grant bargaine & sell y.e same to the Said Daniell Moy and his heyres And that he will for Ever warrant and Defend the same to him the Said Daniell Moy and his heyres against all persons Claiming any Right title or Interest of in or to the p.rmisses or any part thereof and that the said Land and p.rmisses are Free and Cleare of All manner of Incumbrances whatsoever the Rents and Services due and payable to the Said Lord Proprietary and his heyres Lord and Lords of the Fee of the premisses always Excepted and foreprized Provided alwayes and itt is the true intent and meaning of these p.rsents that if the said Richard Moy in his life time or the said Daniell Since the death Shall since the Thirtyeth day of May One Thousand Six hundred Seaventy and foure being the time when the Said Richard first received possession of the said Land and Premisses have Elapsed paying the Rent of the Said Land or done or Omitted any other thing whereby and by which meanes the said Land Should be forfeited to the Lord Propry or his heyres Lord and Lords of the Fee of the Premisses That then and in such Case the said Warranty of the said Thomas to the said Daniell by these p.rsents Given as to the Defending and Warranting the Same shall be Void and of Noe Effect as if the same herein beene never incerted any thing in this Deed to the Contrary hereof in any wise Notwithstanding And the Said Thomas Taylor doth further for himselfe his heyres Exec.rs and Adm.rs Covenant Promise and Agree to and with the said Daniell Moy his heyres Exec.rs and Assignes and Every of them by these p.rsents att any time within these Seaven Yeares next Comeing att the Reasonable Request and att the proper Cost Charge in the Law of him the said Daniell Moy to Doe Acknowledge make and Execute any other lawfully Conveyance or Conveyances Assurance or Assurances in the Law whether be by Fine Recovery or Inrollment of these p.rsents or otherwise whatsoever As by the Councell of the said Daniell Moy learned in the law shall be reasonably Advised Devised or Required Provided that the said Thomas Taylor or his heyres be not Obliged Travaile further then the Citty of S.t Maryes for the Doeing Acknowledging makeing (or |
