163 (154 This Indenture made the Twentieth day of May in the fifth yeare of the Dominion of Charles Absolute Lord and prop.ry of the province of Maryland &c and in the yeare of our Lord god one thousand six hundred and Eighty Betweene Robert Ellye of the County of St Maryes in the province aforesaid gent of the one pt and Andrew Abington of the County and province aforesaid gentl on the other part Witnesseth that the said Robert Ellys for and in Consideracon of the Reuls and Covenants in and by these p.rsents reserved & Contained w.ch on the part and behalfe of the said Andrew Abington his Executo.rs Administrators and assignes are & ought to bee paid done pformed fulfilled and Kept as also for Divers other good causes and Consideracons him the said Robert Ellys Especially moveing Hath Demised granted and to Farme Letten & by these p.rsents Doth Demise grant and to farme Lett unto Andrew Abington his Executo.rs Adm.rs and assignes All that his messuage Tenement or house Comonly called or Knowne by the name of the halfe way house scituate and being in St Maryes County in the province aforesaid and alsoe one parcell of land Called Temple barr Containing One hundred Acres one parcell of land Called Addicon Containing fourty ^one^ Acres and one parcell of Land called Loughbrow Containing one hundred and fifty acres and one parcell of Land Called Oxford Containing Two hundred and nine Acres (Except and alwayes Reserved unto the said Robert Ellys his heyres Executo.rs and Administrators all manner of Trees and Timber Trees growing upon the Land Called Oxford w.th the benifitt of the sealeing therein if hee or they think fitt) Together w.th all houses Edifices buildings gardens Lands pastures proffitts & Chattells particularly menconed in a schedule hereunto annexed To have & to hold the said messuage Tenement houses Lands and p.rmisses goods & Chattells w.th the appurtenances hereby demised and every part and parcell thereof unto the said Andrew Abington his Executo.rs Adm.rs and assignes from the tenth day of October next Ensueing the Date hereof unto the full end and Terme of Five yeares from thence next Ensueing and Fully to bee Compleate and Ended Yeilding and paying therefore yearely and Every yeare dureing the said Tenure of Five yeares unto the said Robert Ellys his Executors Adm.rs or assignes the Rent of Eight thousand pounds of good sound Marchantable Tobacco in Caske & Tenn pounds sterling good and lawfull money of England the said sume or quantity of Eight thousand pounds of Tobacco to bee yearely and Every yeare (as shipping may Conveniently bee had) sent into England & Consigned unto the aforesd Robert Ellys his Executo.rs Adm.rs and assignes marked and nayled in some shipp belonging to or bound for the Citty of London att the onely trouble & Costs of the said Andrew Abbington his Executo.rs Adm.rs and assignes & also the same sume of Tenn pounds ster money of England to bee paid unto the said Robert Ellys his Executors Adm.rs and assignes by bills of Exchange Drawne by the said Andrew Abington his Executo.rs or Adm.rs on some person or psons who shall well and truely accept and pay the same as aforesaid and the said Andrew Abington for himselfe his Executo.rs and Adm.rs Doth Covenant promise and grant to and w.th the said Robert Ellys his heires and assignes by these p.rsents that hee the said Andrew Abington his Executors & Adm.rs or assignes shall and will well and truely pay or cause to bee paid & Consigned as afo.d unto the said Robert Ellys his Executors or Adm.rs in manner & forme as aforesaid the said |
