155 (146 his substitutes or assignes shall Lawfully doe or cause to bee done in or about the Execution of the premisses by vertue of these presents I doe shall and will Rattifie and allowe by these presents I doe shall and will rattifie Confirme and allowe by these presents In witnesse whereof I have hereunto sett my hand and seale the seaventeenth day of October in the thirtieth yeare of the Reigne of our soveraigne Lord Charles the second of England &c Annoq Dom One thousand six hundred seaventy eight Sealed and delivered in y.e p.rsence of Thomas Impey Rich.d Huckeley Barnaby Dunch sealed March y.e 12.th 1678/9 The witnesses To this L.re of Attorney came and proved the same Coram me C Baltemore On the back side of y.e aforegoeing L.re of Attorney was Thus written Know all men that I Walter Dunch by vertue of the within named L.re of Attorney unto me granted doe substitute and appointe my Trusty and beloved friend Thomas Francis of Ann Arrund.ll County in my place and stead Giveing unto my said Constitute my full power and Authority To act and doe in all things According unto the power and Authority to mee Given In witnesse whereof I have sett my hand and Seale This Three and twentieth day of January 1679 signed Sealed and delivered in y.e p.rsence of Thomas [illegible] Samuell Chew Walter Dunch (sealed) William Ball of Baltemore County aged forty yeares or thereabouts Deposes That the Gray Gelding now in question between George Yate and William Cromwell was the pper goods of Richard Maskall doe and at the time of his Death and that hee knew the said Gelding from a Fole And further saith not William Ball sworne in open Court y.e tenth day of Octob.r 1679 W.m Calvert William Davies of Baltemore County aged Twenty Six yeares or thereabouts Deposes That hee was servant to Richard Maskall late of Baltemore County deceased at the time of his death and that the Gelding now in question between George Yate and William Cromwell was the prop goods of his said Master at the time of his death aforesaid And that hee Knew the said Gelding from a Fole of Six or seaven dayes old And further Saith not W.m Davies sworne in open Court the 10.th day of Octob.r 1679 W.m Calvert By this publick Instrument of procuracon or L.re of Attorney bee it knowne and manifest unto all people that on the first day of the month of October Anno Dom 1679 and in the one and thirtieth yeare of the Reigne of our soveraigne Lord Charles the second King of England &c Before me William Scorey Notary and tabellian publick by Authority of our said soveraigne Lord the King admitted and sworne dwelling this Citty of London and in the p.rsence of y.e witnesses hereafter named psonally appeared Deborah Eaton of Roderith neare London widdowe the Relict and Exix of the last will and Testament of Benoni Eaton late of London Maryner dec.d w.ch appeares in the first place Revoakeing all former powers by her made or given to any person or persons for the Following Effect hath de Novo made ordained and in her stead and place hath put & constituted and by these p.rsents doth make ordaine and in her stead and place doth put and constitute Thomas Smithson of Talbott County in Maryland Marchant the Bearer hereof her true and Lawfull Attorney Giveing unto him full power authority and speciall charge for and in the name and to the use of her constituant to aske demand Leavie sue for Recover and (Receive |
