Benj.a Randall sealed Whereupon the said John Burdett by Robert Ridgely his Attorney prayed that the aforesaid Goods together with one thousand & sixty pounds of tobacco formerly Attached in the hands of Henry Hosier might be condemned unto him upon giveing security according to Act of Assembly in that case made & provided And itt is granted by the Court here Now here att this day to witt the foureteenth day of March in the yeare aforesaid came the said John Burdett with Michael Miller his suerty who undertooke for the said John Burdett in the sume of Twenty nine pounds & one penny sterl to indempnifie this Court against all actions suites or other matters that may happen touching or concerning the abovesaid Attachm.ts And shall make restitution of the abovesaid Goods & tobacco or of the value thereof (Except Sheriffee Fees for Attaching the same) in case the said Thomas Peighen or his Attorney shall within one yeare & a day make his just & due defence to the aforesaid action of the said John Burdett & proceed on in the said action in comon forme And make itt appeare that the said John Burdett is satisfied his just demands whereupon the Court condemned the Goods & tobacco so Attached as aforesaid And ordered that the Sheriffe of Kent County aforesaid deliver the same unto the said John Burdett Know all men by these p.rsents that I Barnaby Dunch of London Marchant have assigned ordained made and Constituted and by these presents doe assigne ordaine make & constitute my Loveing Brother Walter Dunch of Lunchouse in the parrish of stepney als Stebben Heath in the County of Middex Maryner my true and Lawfull Attorney for mee in my name and to my use to Demand sue for Leavy recover and receive of and from Collon.ll Will.m Burges and Cap.t Richard Hill and of all and every other person and persons whatsoever Inhabiting within the province of Maryland and of theire Executors adm.rs and assignes All and every such debt and debts sume and sumes of money goods wares Marchandizes and Chattells whatsoever now due or hereafter to growe due or payable unto mee from or by reason of any bond bill booke specialty accompt or otherwise howsoever in any Kinde nature or manner whatsoever or howsoever And I doe hereby grant and give unto my said Attorney my full and whole power and authority to use all such lawfull waies and meanes in and about the executing of the premisses as to my said sumes of money goods wares Marchandizes and Chattells or any of them or any part thereof Acquittances or either reasonable discharges for mee and in my name to make seale and deliver for the same And all and singular other act and acts thing and things device and devices in the Law whatsoever needfull or necessary to bee done in or about the execution of the premisses in my name to doe execute and performe as fully and effectually as I my selfe might or could doe were I personally present to all Intents and purposes and one Attorney or more under him to make & Substitute and the same at pleasure to Revoake All which and whatsoever my said Attorney & (his |
