137) 146 Att wch said third day of June Came here also as well the said Amos Parsons by Robert Ridgely his Attorney as the said William Planner by the said Christopher Rousby his Attorney Likewise the Justices of the said County Court of Somersett County the transcript of the Record proceedings and Judgments in the cause aforesaid to his Lordshipps Justices of the provinciall Court under the hands and seales of William Colebourne George Johnson Frances Jenkins and David Browne his Lordshipps Justices of the said County Court have sent in these words following Viz Som.rsett County fs Att a County Court held the Twelfth day of March in the third yeare of the Dominion of the Right hono.ble Charles Lord Baltemore over Maryland &c.a Annoq Domini One thousand six hundred seaventy seaven by his Lordshipps Justices thereunto assigned and Authorized Present Colon.ll William Colebourne M.r George Johnson Capt David Browne M.r Charles Ballard M.r Francis Jenkins Comission.rs Amos Parsons plantiffe ag.t William Planner as y.e Attor Som.rsett County rs William Planner as the Attorney of Matthew Nelson was of Matthew Nelson Deft summoned to Answere unto Amos Parsons in a plea of Trespas upon y.e Case And Whereupon the said Amos Parsons by Thomas Poole his Attorney Complayneth that hee the said Nelson upon the six and twentyeth day of October in the first yeare of the Dominion of Charles Lord Baltemore &c Annoq Domini One thousand six hundred seaventy six bargained and agreed to and with the plantiffe from the six and twentyeth day of October till the Last day of february to serve him the said Nelson for twelve hundred pounds of Tobacco and Caske and hee the said Nelson did obleige himselfe to bring the said Amos home to Annamessex River the first of March following but hee the aforesaid Nelson him the said Parsons carryed over the bay and when the time wch hee the aforesaid Nelson had agreed for was Expired hee the said Parsons did require the said Nelson to pforme his bargaine and carry him home but hee the said Nelson did refuse the same and would not Lett him the said Parsons Leave his servitude but Kept him there his Bookkeep till the Last day of May in the yeare of our Lord One thousand six hundred seaventy seaven for wch future service there is due to the plantiffe sixteen hundred and fifty pounds of Tobacco both wch sumes amo.th to Two thousand eight hundred and fifty pounds of Tobacco of wch the said Nelson hath paid the plantiffe One thousand foure hundred and six pounds and one halfe of a pound of Tobacco there Remayned still due to the plaintiffe One thousand foure hundred forty three pounds & one halfe pound of Tobacco wch hee the said Nelson when Extant in the County denyed to pay the same although often thereunto required and since William Planner her Attorney hath denyed and still doth to pay the same and still doth to pay the said sume of one thousand foure hundred forty three pounds and hone halfe pound of Tobacco Att the pl.th Losse and dammage Two thousand nine hundred and ninety pounds of Tobacco therefore hee bringeth this suite against William Planner the Attorney of Matthew Nelson p quer Thomas Poole Pledg John Doe Richard Roe And the p.lt produced this following Writing wch is Read Viz Novemb.r y.e 1.st 1696 ℓℓ Tob Hyred to bee Bookkeeper unto Matthew Nelson Marchant from the first day of November untill the Last day of February 1676 for 1200 For three monethes service att 550.ℓ Tob p moneth 1650 Erro.rs excepted p me Amos Parsons 2850 And |
