12 Assignements or other writeings as shall be Requisite and needfull And the Buyer or buyers fully to possesse of and in what he or they Shall purchase and thereof and therefrom Clearly to dispossesse and disseize the said Constituant his Agents or Assignes And the price or prices and product of such sale or Sales to take and receive to and for the Use & benifitt of the said Constituant and thereupon to passe due release and discharges Further if neede be to appeare before all Lords Judges & Justices in any Court or Courts there to answer defend and reply in all matters and Causes concerning the premisses To doe Say pursue implead arrest Seize Sequester attach imprison and to Condemne and out of prison againe to Deliver And Generally in and Concerning the premisses to doe Act mannage and performe all and Every thing and things Customes & formalityes whatsoever which shall be necessary and Convenient Either by Course of law or otherwise as fully and amply to all intents and purposes as he the said Constituant himself might or Could personally doe although the Case Should require A more Ample authority then herein is Contained With Power to Substitute one or more Attorneys and the same againe att his pleasure to revoake He the said George White hereby Ratifying and Confirming and promissing and Obligeing himselfe his heyres Exec.rs Adm.rs and Goods present & future to hold for firme good Stable and of Vallue for Ever all and whatsoever the Said Thomas Taylor his Attorney or his Substitutes shall lawfully doe Cause or procure to be done in and about the premisses by Virtue of these p.rsents and to doe or oppose against the same in any manner In Witness whereof the Said Constituant hath hereunto putt his hand & Seale ^thus done^ and passed in London aforesaid in p.rsence of the psons underwritten Witnesses hereunto Required Sealed and delivered in p.rsence of George White Sealed John Dunth Walter Dunth Leon Webber Nicholas Sewall In Testimonium Veritatis Signe meo manuali Solito 8 1/2 sides Signavi & Tabellionat mei Sigillum upposui regatus Nic Hayward No Pub Sealed This Indenture made the Eighteenth day of Aprill in the second yeare of the Dominion of the Right Hon.ble Charles Lord Charles Lord Baltemore Lord & Proprietary of the Provinces of Maryland and Avalon Over the said Province of Maryland and in the Year of Our Lord God One Thousand Six hundred Seaventy and seaven Betweene Thomas Gerard of Westword in the County of S.t Maryes in the said Province of Maryland Gentl of the one party And the Hon.ble Thomas Notley of Wiccocomico River in the said County of S.t Maryes in the said Province of Maryland Esq.r of the other party Witnesseth that whereas in the Records of the provinciall Court of the Said Province of Maryland is Conteined as followeth (viz.t) Maryland fs Att A Provinciall Court held att the Citty of S.t Maryes the fifteenth day of Febry in the Forty Third Yeare of the Dominion of Cæcilius &c before his Lordpps Justices thereunto assigned Thomas Gerard ag.t John Gerard & Rose Gerard Exec.rs of Thomas Gerard Rose Gerard & John Gerard Exec.rs of the last will & Testament of Thomas Gerard Esq.r deceased were sumoned to Answer unto Thomas Gerard Gentleman of A plea that they hold to him the Covenants betweene the said Thomas Gerard Esq and Thomas Gerard the younger Gentleman according to the former force & Effect of Certaine Indentures thereupon between them made &c And Whereupon the said Thomas Gerard the Younger by Robert Carvile his Attorney saith that Whereas by A Certeyne Indenture made the Ninth day of Jan.ry in the Fortyeth Yeare of the dominion of Cæcilius &c Annoq Dom One Thousand six hundred seaventy & one Betweene the Said Thomas Gerard Esq.r in his life time on the one part and the said Thomas Gerard the Young.r Gentl of the other part which other part signed with the Seale of the aforesaid Thomas Gerard Esq.r the said Thomas Gerard the Younger produced here in Court Whose date is the day and yeare above said It is Witnessed that he the said Thomas Gerard Esq.r for and in Consideration of the Naturall Love and affection which he had & did beare to his sonne the said Thomas Gerard Jun.r as alsoe for the Consideracon therein after Expressed did Grant Bargaine sell Alien Enfeoffe & Confirme unto the said Thomas Gerard the Younger All that the Manno.r of Westwood in the County of S.t Maryes in the Province of Maryland with the appurtenances in the Said Indenture pticularly mentioned And alsoe all that parcell or Tract of land Comonly Called or Knowne by the name of the Meadows Scituate Lyeing and (Being |
