105 96 Memorand That Jane Marshe the said wife of Thomas Marsh came before me this Last day of March and att the request of Thomas Starling and did acknowledge that she did Consent to the Saile of the Land in this Indenture menconed without any feare Threats or otherwise from her said Husband and that her hand hereunto fixed shee ownes to bee her free ^and willing^ Act One thousand six hundred seaventy Nine Henry Coursey Knowe all men by these p.rsents That I Thomas Marshe of Kent County in the Province of Maryland gentl inn holden and firmely bound to Thomas Starling of the Clifts in Calvert County Planter in the full sume and Just quantity of Fource Score Thousand pounds of good sound and every way well Condiconed Marchantable Tobacco in Caske to be paid to the said Thomas Starling his Certaine attorney his Executo.rs adm.rs or assignes to which payment well and truely to bee made and donne I bind myselfe my heyres Executo.rs adm.rs firmely by theise presents sealed with my seale dated the Fourth day of May in the second yeare of the Dominion of the Right Honourable Charles absolute Lord and Proprietary of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c annoq Domini One thousand six hundred seaventy six The Condicon of this p.rsent above written obligacon is such That if the above bounden Thomas Marshe his heyres executo.rs Adm.rs and assignes and every of them shall and doe well and truely hold observe performe fullfill and keepe all and every the Covenants guifts grants Articles Clauses and agreements mentioned and Conteyned in one Indenture of bargaine and sale of the date of these p.rsents above written had and made by and betweene the said Thomas Marshe of the one parte and the above named Thomas Starling of the other part which on the parte and behalfe of the said Thomas Marshe his heyres Executo.rs Adm.rs and assignes are and ought to be holden observed & formed fullfilled and kept according to the true intent and meaning of the said Indenture respectively in all poynts and Condicons That then this p.rsent above written obligacon shall be voyd and of none effect otherwise to stand and remayne in full power force strength and virtue Signed sealed and delivered Thomas Marshe sealed in the presence of Benj.a Randall Jo Scott To all that shall see these presents or heare them to be read S.t Francis Chaplin Knight Lord Major and the Aldermen and or Senators of the Cittie of London Send greeting Know yee that on the day of the date hereof in the Kings Majesties Court holden before us in the Chamber of the Guild hall of the said Citty personally came and appeared James Glavin of Greys June Lane near the Cittie of London Victualler aged sixty yeares or thereabouts Being a person well knowne and worthy of good Faith and Creditt And did by his Solemne Oath which hee tooke upon the holy Evangelists of Almighty God Att the instance and request of Thomas Glavin of Livington in the County of Hampton Gentleman Before us then and there Solemnly declare testifie and depose to bee true That the ^said^ Requestant Thomas Glavin is the reputed naturall and legitimate Eldest Brother now Living of Bartholomew Glavin late of Maryland in Virginia Chirurgeon deceased which this deponent knoweth to be true because he is the Vuckle of the said Requestant and was none Bother to his Father Thomas Glavin of Livington aforesaid Mercer deceased In Faith and Testimony whereof wee the said Lord Major and Aldermen the Seale of the office of Majoralty of the said Citty of London to these presents have caused to be put and affixed dated in London the six and twentieth day of July Anno Dui 1678 And in the thirtieth yeare of the reigne of our Soveraigne Lord Charles the Second By the |
