SECTION 1. Be it enacted by the County Council of
Talbot County, Maryland, that Rules of Procedure for the
conduct of hearings and other business of the County
Board of Appeals be, and they are hereby, established
pursuant to Section 503 of the Charter for Talbot County,
Maryland as follows:

RULES OF PROCEDURE
I. Organization.
The Board of Appeals shall elect from its members a
Chair nan who shall preside at all hearings of the Board,
shall set the date for hearings, and cause to be
published notices of hearings. The Board shall likewise
elect a Vice Chairman who shall perform the duties of the
Chair nan when the chairman is absent. In the event of
the absence of both the Chairman and the Vice Chairman at
any hearing, the remaining members of the Board shall
elect a Chairman pro tem for the conduct of such hearing.
The presence of three members at any hearing or
meeting of the Board shall constitute a quorum for the
conduct of a hearing or the transaction of business.
In the event that any applicant or appellant shall
be denied the relief requested by a vote of less than
three members of the Board, the applicant shall be
entitled to a rehearing before the full Board.
II. Form of Appeals
A. Requests for variances and special
exceptions under the Talbot County Zoning Ordinance shall
be made on forms provided by the Board of Appeals, a
sample of which is attached hereto as Form A.,
accompanied by such filing fee as may be fixed by the
County Council from time to time.
B. Appeals from orders relating to licenses
and permits, building, subdivision, plumbing and
electrical statutes and codes, or from executive,
administrative or adjudicative orders shall be on forms
provided by the Board of Appeals, a sample of which is
attached hereto as Form B., accompanied by such filing
fee as may be fixed by the County Council from time to
time.
