not make or authorize any expenditure that will result in
exceeding in the five months prior to the general
election day a total amount expended on behalf of a
candidate or in support of or in opposition to a
principal or proposition, an amount equal to ten cents
times the total population, as determined by the latest
pronouncements of the United States Bureau of the Census,
or the State, District, or other area within which the
election, whether primary, general, or special, is held.
In any period of thirty—eight months prior to the
period of five months prior to the above—mentioned
general election day of the single election, the
treasurer or subtreasurer or combination thereof of any
political committee or committees as defined herein, may
not make or authorize any expenditure that will result in
exceeding in this thirty—eight month period, an amount
equal to fifteen cents times the total population, as
determined by the latest pronouncements of the United
States Bureau of Census, of the State, District, or other
area within which the election, whether primary, general
or special is held.
SECTION 28—12. Sanctions. Any person who
willfully violates this section shall be guilty of a
misdemeanor and upon conviction may be imprisoned for not
more than six (6) months or fined not more than one
thousand dollars ($1,000.00) or both.
SECTION 2. Severability. The provisions of this
Act are severable and if any provision, sentence, clause,
section or part thereof is held illegal, invalid or
unconstitutional or inapplicable to any person or
circumstances, such illegality, invalidity or
unconstitutionality, inapplicability shall not affect or
impair any of the remaining provisions, sentences,
clauses, sections or parts of the Act or their
application to other persons or circumstances. It is
hereby declared to be the legislative intent that this
Act would have been adopted if such illegal, invalid or
unconstitutional provision, sentence, clause, section or
part had not been included therein.
SECTION 3. BE IT FURTHER ENACTED, that the County
Council hereby declares that an emergency exists
affecting public health, safety and welfare, said
emergency being the need for the bill to take effect as
early as possible prior to the oncoming election.
SECTION 4. BE IT FURTHER ENACTED, That this bill
shall take effect on the date it becomes law.
