COUNTY LOCAL LAIS

responsible for assisting the Chief Administrative
Officer in administering the Employees' Retirement System
of Montgomery County and such other retirement systems
that the County is funding.

(b)    Rules and regulations for
administration. The Chief Administrative Officer shall
establish rules and regulations for the administration of
the retirement system, within the limitations of this
Article, and may engage actuarial and other services and
incur expenses as required to transact the business of
the retirement system.

(c)    Payment of expenses. All expenses
incurred in operating the retirement system will be paid
from budget appropriations approved by the County Council
or from the funds.

(d)    Legal advisor. The County Attorney
shall be the legal advisor.

(e)    Certification by Personnel Director. At
the direction of the Chief Administrative Officer the
Personnel Director may certify all retirements and all
benefits payable under the system.

(f)    Records. The Personnel Office shall
keep a record of all proceedings, which shall be open to
public inspection.

(g)    Hearings. The County Personnel Board
may hold hearings when deemed necessary in the
performance of its duties. The hearings will be governed
by the rules and regulations provided in the Personnel
Regulations, and the Board shall not be bound by
technical rules of evidence.

SECTION IX. Section 48 (a), title "Composition" is
hereby amended to read as follows:

(a) Composition. The Retirement Hearing
Board shall be composed of three members who are
qualified voters of Montgomery County, with members
appointed by the County Executive and subject to
confirmation by the County Council. One member shall be
appointed every other year for a term of six years,
commencing July 1, or until their successors have been
appointed. Any member appointed to fill a vacancy
occurring prior to the expiration of a term shall be
appointed for the remainder of that term. No member of
the Retirement Hearing Board may be a representative or
agent of a County employee group, or a physician. The
compensation of the members of the Retirement Hearing
Board shall be fixed by the County Council and the
