(h) Administrative retirement on or after elective
early retirement date or normal retirement date. The
County Executive or Chief Administrative Officer may
retire any member under the supervision of the County
Executive or Chief Administrative Officer who is eligible
for elective early retirement or normal retirement if the
action is justified and demonstratively in the best
interest of the County. The decision of the County
Executive or the Chief Administrative Officer may be
appealed to the County Personnel Board. Appeal
procedures provided in the Personnel Regulation shall be
followed in making and handling appeals. Such retirement
shall be considered as a separation from the County
service in good standing and without prejudice. Any
member who is retired May 1, 1970, or thereafter, shall
receive a pension commencing immediately and the
provisions of Section 33—45 (c) shall be applicable in
determining the amount of pension.
SECTION III. Sections 41 (a), title "Member's
credited service", 41 (b), title "Procedures for
determining credited future service", 41 (i), title
"Credited service for prior military service", 41 (p),
title "Transfers to County Retirement System", and 41
(r), title "Other transfers to the County's Retirement
System", are hereby amended to read as follows:
(a) Member's credited service. A member's
credited service equals the sum of credited future
service and credited past service, determined as follows:
(1) Credited future service is credited
service rendered by a member after the effective date of
this Retirement System.
(2) Credited past service is service
credited under the Employees' Retirement System of the
State of Maryland or the Montgomery County Police Relief
and Retirement Fund Law. A member will not receive
credited past serviced unless an election to transfer to
this Retirement System was filed on or before December
3 1, 1966. Any member who had membership in the Police
Relief and Retirement Fund of Montgomery County, and upon
discontinuance of coverage prior to August 15, 1965, was
unable to receive the return of member contributions,
shall receive credit for service covered by such
contributions.
(3) Credited past service for service as a
fire alarm dispatcher or firefighter in Montgomery
County. Any member shall have the opportunity to obtain
credit for any period of full—time paid service as a fire
alarm dispatcher or firefighter in a Montgomery County
