COUNTY LOCAL LAWS
August 15, 1965. A qualified part—time paid employee of
the County or participating agency may become a member,
on an individual option basis, if the following
requirements are met:
(1) the employee has not reached age
fifty-five.
(2) the employee waives on a form prescribed
by the County Personnel Board all rights of membership
under any other retirement system supported in whole or
in part by the State of Maryland or any political
subdivision thereof, including Montgomery County;
(3) the employee fully meets the medical
standards established by the Chief Administrative Officer
after taking a physical examination administered by the
Medical Examiner.
(4) the employee makes application for
membership within five work days after beginning work,
with membership retroactive to the first day of work.
Any employee who fails to exercise this option is not
eligible to do so at a later date.
(e) Employees not eligible for membership. Any
employee falling within one of the following categories
is not eligible for membership:
(1) A recipient of Social Security disability
benefits;
(2) A recipient of a disability award under
the Workmen's Compensation Laws of any State, District,
or Territory unless specifically approved for membership
by the County Personnel Board;
(3) A recipient of disability retirement
benefits under any other retirement system except any
employee who may be receiving disability benefits as the
result of service in the Armed Forces of the United
States.
(j) Membership Groups and Eligibility. Any
full—time or qualified part—time employee shall be
eligible for membership in the appropriate membership
group outlined below if all requirements for the group
are net:
Group A: Any full—time or qualified part—time
employee who is not eligible for coverage under another
membership group shall be a Group A member. A qualified
part—time employee is only eligible for membership in
Group A.
