COUNTY LOCAL LAWS

County service or Service of the County — employment
with the Montgomery County Government or any agency whose
employees participate as members of this Retirement
System, and full-time or qualified part-time service with
another agency by the incumbent of a position brought
under the County's merit system without a break in
service.

Regular Earnings or Earnings— gross pay for actual
hours worked in a bi—weekly period exclusive of overtime.

Average final earnings — regular earnings of a
full-time or part—time career member for the twelve
months immediately preceding retirement or any
consecutive twelve month membership period, whichever is
greater. Whenever a member is in leave without pay
status during part of the final twelve month period,
average final earnings will be the last twelve months
during which the member was in full pay status.

Average final earnings for a member who has
full-time service credits and is a part—time career
member at time of retirement will be the average hourly
rate of earnings during the last twelve months of
membership or any consecutive twelve month membership
period, whichever is greater, multiplied by two thousand
eighty. The average hourly rate for any twelve month
period is equal to the total regular earnings of the
member, divided by the total number of hours worked
during the period.

County employee member — employees or appointed and
elected officials of the Montgomery County Government.

Discontinued Service — Administrative Retirement on
or after normal retirement date or on or after elective
early retirement date.

Actual Service — County service in pay status.

Continuous Service — County service in pay status
including any authorized pay leave or any military leave
without pay grant that qualifies under the appropriate
provisions of the Personnel Regulations.

Normal Working Time — the number of hours a member
would be expected to work in a yearly period including
paid authorized leave as may be provided in the Personnel
Regulations. In the case of a part—time career member,
such "normal working time" will be whatever scheduled
work time may be set forth as a condition of the member's
appointment.
