VEHICLE UPON THE HIGHWAYS, ROADS, STREETS, OR OTHER
PUBLIC PROPERTY IN THE COUNTY AT ANY TIME.

Sec. 4. Severability.

The provisions of this Act are severable, and if any
provision, sentence, clause, section or part thereof is
held illegal, invalid or unconstitutional, or
inapplicable, to any person or circumstances, such
illegality, invalidity or unconstitutionality, or
inapplicability, shall not affect or impair any of the
remaining provisions, sentences, clauses, sections or
parts of the Act or their application to other persons or
circumstances. It is hereby declared to be the
legislative intent that this Act would have been adopted
if such illegal, invalid or unconstitutional provision,
sentence, clause, section or part had not been included
therein, and if the person or circumstances to which the
Act or any part thereof is inapplicable had been
specifically exempted therefrom.

Sec. 5. Effective Date.

This Act shall take effect on the 76th day following
the date on which it becomes law.

48(c), 58(b), 35; to delete Sections 42(f) and 43 (i) in
their entirety, to repeal and re—enact Section 48(f) in
its entirety and renumber as Section 48(h), and to add
Sections 44(e), 48(f), 48(g), 48(i) , of Article III,
title "Employees' Retirement System of Montgomery
County," of Chapter 33, title "Personnel" of the
Montgomery County Code 1972, with respect to certain
provisions of the Employees' Retirement System to provide
for membership eligibility for other than County
employees; to provide for optional membership for
qualified part—time employees; to provide for membership
