AN ACT to amend Article V, title "Contracts,
Purchases and Sales," of Chapter 20, title "Finance",
Montgomery County Code 1972, by repealing and
re-enacting, with amendments. Section 20-24 thereof,
title "Non—discrimination in Employment," to provide for
the addition of the word "sex" in the County's policy of
non—discrimination in employment by contractors.
BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that -
SECTION 1. Section 20-24, title "Non-discrimination
in Employment," Article V, title "Contracts, Purchases
and Sales", of Chapter 20, title "Finance", Montgomery
County Code 1972, is hereby repealed and re-enacted, with
amendments, to read as follows:
20-24. Non—discrimination in Employment.
The Chief Administrative Officer shall, subject to
the direction of the County Executive, insure that each
and every county contractor adheres to the following
standard and each contract shall contain a requirement
therefor. The contractor shall not discriminate against
any employee or applicant for employment, because of
race, creed, color, sex, or national origin. The
contractor shall take affirmative action to insure that
applicants are employed and that employees are treated
during employment without regard to their race, creed,
color, sex, or national origin. Such action shall
include but not be limited to the following: employment,
upgrading, demotion, or transfer; recruitment or
recruitment advertising; layoff or termination; rates of
pay or other forms of compensation; and selection for
training, including apprenticeship. The contractor shall
be required to post in conspicuous places, available to
employees and applicants for employment, notices setting
forth this policy of non—discrimination.
In the event of the contractor's noncompliance with
the non—discrimination provisions herein, the contract
may be cancelled, terminated or suspended in whole or in
part and the contractor may be declared ineligible for
further county contracts, and such other sanctions may be
imposed and remedies invoked as provided for in rules and
regulations established by the Chief Administrative
Officer.
SECTION 2. Effective date.
This Act shall take effect on the 76th day following
the date on which it becomes law.
