REVISOR'S NOTE: This subsection presently appears as
Art. 83, §20(h).

In light of the present reference to
"consumers," defined in subsection (c) of this
section, the adjective "consumer" is added,
for purposes of conformity, to modify "goods,
services, or credit"; and, for purposes of
clarity, the inconsistently broader term
"merchandise" is deleted. No change in
substance results from these changes.

The only other changes are in style.

(H) PERSON.

"PERSON" INCLUDES AN INDIVIDUAL, CORPORATION,
BUSINESS TRUST, ESTATE, TRUST, PARTNERSHIP, ASSOCIATION,
TWO OR MORE PERSONS HAVING A JOINT OR COMMON INTEREST, OR
ANY OTHER LEGAL OR COMMERCIAL ENTITY.

REVISOR'S NOTE: This subsection is new language
setting forth a broad, standardized definition
of the word "person" as used in this article.
It is a synthesis of the U.C.C. definitions of
"person" and "organization" contained in
§1—201 (28) and (30) of this article, except
that the reference to "government and
governmental subdivision or agency" is not
included. This definition, which replaces
that presently appearing in Art. 83, §20(e),
is in no way intended to change the present
law, merely to clarify it.

(I) SALE.

"SALE" INCLUDES ANY:

(1)   SALE OF OR OFFER OR ATTEMPT TO SELL
MERCHANDISE, REAL PROPERTY, OR INTANGIBLES FOR CASH OR
CREDIT; OR

(2)    SERVICE OR OFFER FOR SERVICE WHICH
RELATES TO ANY PERSON, BUILDING, OR EQUIPMENT.

REVISOR'S NOTE: This subsection presently appears as
Art. 83, §20(d).

In item (1) of this subsection, the terms
"real property" and "intangibles," derived
from the present definition of "merchandise,"
are added for purposes of emphasis. In this
regard, see revisor's note to subsection (f)
of this section.
