(2)    REMAINS IN OR UPON ANY VEHICLE ON ANY PUBLIC
STREET, SIDEWALK OR PATHWAY (INCLUDING THOSE PRIVATELY
OWNED BUT USED BY THE PUBLIC IN GENERAL) SO AS TO
OBSTRUCT THE FREE PASSAGE OF ANY PEDESTRIAN OR VEHICLE
AFTER A REGULAR OR SPECIAL POLICE OFFICER (EITHER IN
UNIFORM OR WHO IDENTIFIES HIMSELF BY CREDENTIAL) HAS
NOTIFIED SUCH PERSON THE ACTION IS UNLAWFUL AND HAS
REQUESTED HIM TO MOVE ON.

(3)    REFUSES, FAILS TO LEAVE, OR REFUSES TO REMOVE
HIS VEHICLE FROM ANY PRIVATE BUSINESS, COMMERCIAL
ESTABLISHMENT, OR ANY PARKING LOT WHICH IS POSTED WITH
CONSPICUOUS "NO LOITERING" SIGNS WHEN THE BUSINESS OR
ESTABLISHMENT IS NOT OPEN FOR BUSINESS, AFTER HAVING BEEN
REQUESTED TO LEAVE BY THE OWNER, HIS AGENT, OR A REGULAR
OR SPECIAL POLICE OFFICER (EITHER IN UNIFORM OR WHO
IDENTIFIES HIMSELF BY CREDENTIALS); PROVIDED, HOWEVER,
THAT THERE IS NO VIOLATION OF THIS SUBSECTION BY ANY
PERSON WHO:

(I)    HAS WRITTEN PERMISSION FROM THE OWNER,
LESSEE OR OPERATOR TO BE PRESENT, OR

(II)   IS WINDOW SHOPPING UNDER CONDITIONS AND
AT SUCH TIME OF THE DAY OR NIGHT WHICH A REASONABLE MAN
WOULD CONSIDER CONDUCIVE TO SUCH ACTIVITY.

(3-A) REFUSES OR FAILS TO LEAVE ANY PRIVATE BUSINESS
OR COMMERCIAL ESTABLISHMENT WHICH IS OPEN FOR BUSINESS
(INCLUDING BUT NOT LIMITED TO LAUNDRIES, EATING
ESTABLISHMENTS, NIGHT BANKING FACILITIES), OR PARKING LOT
THEREOF, AFTER HAVING BEEN REQUESTED TO DO SO BY THE
OWNER OR HIS AGENT.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 6-111.1 (a) (6) be, and it is hereby added to said
Code, Title and Subtitle, to follow immediately after
Section 6-114.1(a)(5) thereof, and to read as follows:

Section 6-114.1(a)

(6) RETURNS WITHIN TWENTY-FOUR (24) HOURS TO THE
SAME PUBLIC OR PRIVATE. PROPERTY FROM WHICH HE WAS ASKED
TO LEAVE, FOR NO APPARENT LAWFUL BUSINESS OR PURPOSE.

SECTION 3. AND BE IT FURTHER ENACTED, That Section
6-114.1 (c) of said Code, Title and Subtitle be, and it
is hereby repealed and re-enacted, with amendment, to
read as follows:

Section 6-114.1

(c) Any person violating the provisions of this
section shall be guilty of a misdemeanor, and, upon
