COUNTY LOCAL LAWS

SECTION 1-225(G), WHO RETIRES ON OR AFTER HIS NORMAL
RETIREMENT DATE SHALL BE ENTITLED TO RECEIVE, COMMENCING
ON THE FIRST DAY OF THE MONTH COINCIDING WITH OR NEXT
FOLLOWING HIS DATE OF RETIREMENT, AN ANNUAL PENSION EQUAL
TO ONE AND EIGHT TENTHS PERCENT (1.8%) OF HIS FINAL
EARNINGS FOR EACH YEAR OF CREDITED SERVICE, PROVIDED THAT
THE TOTAL BENEFIT DOES NOT EXCEED SIXTY PERCENT (60%) OF
HIS FINAL EARNINGS.

SECTION 1-225

(G) (1) IF THE PARTICIPANT IS DEEMED TO BE
TOTALLY AND PERMANENTLY DISABLED UNDER SUBSECTION (A) OF
THIS SECTION, THE ANNUAL AMOUNT OF HIS DISABILITY PENSION
SHALL BE EQUAL TO (I) MINUS (II) WHERE (I) IS ONE AND
EIGHT TENTHS PERCENT (1.8%) OF HIS FINAL EARNINGS FOR
EACH YEAR OF CREDITED SERVICE (PROVIDED THAT THE TOTAL
BENEFIT SO COMPUTED DOES NOT EXCEED SIXTY PERCENT (60%)
OF HIS FINAL EARNINGS) OR TWENTY-FIVE PERCENT (25%) OF
HIS FINAL EARNINGS, WHICHEVER IS GREATER, AND (II) IS THE
AMOUNT OF EARNINGS, IF ANY, RECEIVED BY THE EMPLOYEE
DURING THE YEAR IN A GAINFUL OCCUPATION, TO THE EXTENT
THAT SUCH EARNINGS EXCEED THE CURRENT ANNUAL EARNINGS OF
AN EMPLOYEE SIMILARLY CLASSIFIED.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 1—224(c) be and it is hereby added to said Code,
Title, Subtitle and Article, to follow immediately after
Section 1—224(b)(5) thereof, and to read as follows:

SECTION 1-224

(C)                    EACH PARTICIPANT WHO IS RECEIVING

DISABILITY PENSION PAYMENTS IN ACCORDANCE WITH SECTION
1-225(G) IMMEDIATELY BEFORE HIS NORMAL RETIREMENT DATE
SHALL RETIRE ON HIS NORMAL RETIREMENT DATE AND SHALL BE
ENTITLED TO RECEIVE, COMMENCING ON SUCH DATE, AN ANNUAL
PENSION EQUAL TO THE GREATER OF:

(1)     THE AMOUNT HE WAS RECEIVING UNDER THE
TERMS OF SECTION 1-225(G) OR

(2)     THE AMOUNT DETERMINED FROM SECTION
1-224(A).

SECTION 3. AND BE     IT FURTHER ENACTED, That this

Ordinance shall take effect   forty—five (45) days from the
date it becomes law.
