SECTION 2. AND BE IT FURTHER ENACTED, That this
Ordinance shall take effect forty-five (45) days from the
date it becomes law.

AN ORDINANCE to repeal Sections 1-221(j), 1-224(a)
and 1-225(g)(1) of the Anne Arundel County Code (1967
Edition and Supplements), Title 1, "Administration,"
Subtitle 2, "Personnel," Article III, "Employees'
Retirement Plan," and to enact new Sections 1-221(j),
1-224(a) and 1-225(g) (1) in lieu thereof, to stand in the
place of the sections repealed, and to add new Section
1-224(c) to said Code, Title, Subtitle and Article,
respectively, to revise the Employees' Retirement Plan in
order to redefine the term "final earnings," to provide
for the annual pension of participants to retire on or
after the normal retirement date, to provide for the
annual amount of disability pension payable to a
participant and to provide for retirement benefits of
participants who received disability pension payments
immediately prior to the normal retirement date; and
matters generally related thereto.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Sections 1-221(j),
1-224(a) and 1-225(g)(1) of the Anne Arundel County Code
(1967 Edition and Supplements), Title 1,
"Administration," Subtitle 2, "Personnel," Article III,
"Employees' Retirement Plan," be and they are hereby
repealed and new Sections 1-221(j), 1-224(a) and
1-2 25(g) (1) are hereby enacted in lieu thereof to stand
in the place of the sections repealed and to read as
follows:
SECTION 1-221
(J) THE TERM "FINAL EARNINGS" MEANS THE
HIGHEST AVERAGE RATE OF EARNINGS OF THE THREE (3) HIGHEST
YEARS OUT OF THE LAST FIVE (5) PRIOR TO RETIREMENT,
DISABILITY, OR DEATH.

(A) EACH PARTICIPANT, OTHER THAN ONE WHO IS
RECEIVING DISABILITY PENSION PAYMENTS IN ACCORDANCE WITH
