HURLOCK
the Mayor shall appoint three qualified voters of the
Town of Hurlock to act as Judges, and every person so
appointed before an election is opened shall appear
before a [Justice of the Peace] JUDGE OF THE DISTRICT
COURT or Notary Public for Dorchester County, and take
oath "that he will faithfully and impartially permit
every person to vote at such election who shall be duly
qualified, and that he will not suffer any person to vote
at such election who shall not be legally qualified to
vote", and in case of failure of any of said person or
persons so appointed to appear and qualify the Mayor
shall issue a certificate to one or more persons to act
as such Judge or Judges, who shall qualify as above, and
they shall immediately after the election return to the
Clerk of Hurlock under their hands the number of votes
cast and for whom cast, who shall file the same at once
and issue certificates of election to the person or
persons receiving the largest number of votes for the
respective offices [, provided, that for the first
election held under this amended Charter the present
Councilmen of Hurlock shall conduct the same in
accordance with the provisions of this sub—title].
287. Same; tie votes.
If IN any election for Mayor or Councilmen there
shall be a tie vote between any candidate or candidates
for the same office, a special election shall be called
by the Mayor and Council and shall be conducted in the
same manner as is provided for in Section 285 of this
subtitle.
288. Procedure for filling vacancies.
If any vacancy shall occur in the office of Mayor or
Council by death, removal, resignation, failure to
qualify or otherwise, those remaining of the Mayor and
Council of Hurlock at their next regular meeting or
within 30 days shall elect a suitable person as Mayor or
Councilman as the case may be to serve until the next
election who shall subscribe to the oath which shall be
certified to and recorded as is provided in Section 289,
and if at any time it shall occur that there is no Mayor
or Councilman of Hurlock in office, any five qualified
voters residing in said City of Hurlock may in writing
call upon [any Justice of the Peace in the town of
Hurlock or] A JUDGE OF THE DISTRICT COURT of Dorchester
County to hold an election as in the case of the first
election under this Charter, and [such], THE special
election may be held at any time after the Corporation
ceases to have any Mayor or Councilman, and the Mayor and
Councilmen so elected shall hold office until the time
for a regular election arrives and until their successors
are elected and qualified.
