FUNKSTOWN

the MAYOR AMD COUNCIL OF FUNKSTOWN, [Burgess and
Commissioners of Funkstown], and by that name may sue and
be sued, and may have and use a common seal.

234. OFFICERS; ELECTION, TENURE.

The legally qualified voters of the State, who shall
have resided within the corporate limits of said Town,
for a period of twelve (12) months next preceding the
election, shall elect, by ballot, on the first Monday in
May, in the year 1929, A MAYOR, AN ASSISTANT MAYOR AND
FIVE COUNCILMEN, [a Burgess, an Assistant Burgess and
five commissioners] for said Town, which said officers
shall have the same qualifications as the voters and
shall be bona fide owners of real estate situated within
the corporate limits of said Town. THE MAYOR AND
ASSISTANT MAYOR, [The Burgess and Assistant Burgess]
shall be elected for the period of one (1) year, and
their successor shall be elected on the first Monday in
May of each and every year thereafter. Two of said
COUNCILMEN, [Commissioners] elected in said year 1929
shall be elected for the period of one (1) year and their
successors shall be elected, on the first Monday in May
of each and every even year thereafter, for the period of
two (2) years. Three of said COUNCILMEN [commmissioners]
elected in said year of 1929 shall be elected for the
period of two (2) years and their successors shall be
elected on the First Monday in May of each and every odd
year thereafter.

236.       RUN-OFF ELECTIONS.

If at any election for MAYOR, ASSISTANT MAYOR AND
COUNCILMEN, [burgess, assistant burgess and
commissioner], any two or more persons shall have an
equality of votes, so that no choice shall be made, a
second election shall be held, after not less than ten
days' notice, and so on until a choice shall be made.

237.  VACANCY IN OFFICE; HOW FILLED.

If during the year for which they were elected, the
MAYOR, THE ASSISTANT MAYOR, OR ANY OF THE COUNCILMEN
[burgess, the assistant burgess, or any of the
commissioners] shall die, resign, remove from said town
or be otherwise disqualified or displaced, the remaining
members of said board shall appoint successors to fill
such vacancies.

238. OATH OF OFFICE.

The said MAYOR AND ASSISTANT MAYOR AND COUNCILMEN
[burgess and assistant burgess and commissioners] shall
qualify by making oath, before some justice of the peace
