hereby repealed to the extent of such inconsistency.

SECTION III: BE IT FURTHER RESOLVED AND ORDAINED
that the Mayor of the City of Frederick shall send
separately by registered mail to the Secretary of the
State of Maryland and the Department of Legislative
Reference the complete text hereof; the date of
referendum election, if any; the number of votes cast for
and against the question containing the Charter
amendment, whether in the legislative body or in a
referendum and the effective date of the Charter
amendment.

RESOLUTION 8-74

A RESOLUTION TO PROPOSE AN AMENDMENT TO ARTICLE
XVII OF THE CHARTER OF THE CITY OF FREDERICK,

ENTITLED, "MISCELLANEOUS PROVISIONS", BY
REPEALING SECTION 212, "GENERAL PENALTY", AND
PLACING IN LIEU THEREOF A NEW SECTION 212,
"GENERAL PENALTY".

SECTION I: BE IT RESOLVED, ENACTED AND ORDAINED by
the Mayor and Board of Aldermen of the City of Frederick,
that the Charter of the City of Frederick, as the same
was adopted by the General Assembly of Maryland, in
Chapter 539 of the Laws of 1951, be amended by repealing
Article XVII, "Miscellaneous Provisions", Section 212,
"General Penalty" in its entirety and placing in lieu
thereof the following:

ARTICLE XVII. MISCELLANEOUS PROVISIONS.

Section 212. General Penalty.

EVERY ACT OR OMISSION DESIGNATED AS A MISDEMEANOR IN
THIS CHARTER, UNLESS OTHERWISE PROVIDED, SHALL BE
PUNISHABLE UPON CONVICTION BEFORE ANY TRIAL MAGISTRATE OR
DISTRICT COURT JUDGE OR IN THE CIRCUIT COURT OF THE
COUNTY WITHIN WHICH THE OFFENSE IS COMMITTED BY A FINE
MOT EXCEEDING THREE HUNDRED DOLLARS OR IMPRISONMENT FOR
TWO MONTHS OR BOTH IN THE DISCRETION OF THE MAGISTRATE OR
DISTRICT COURT JUDGE OR COURT. THE PARTY AGGRIEVED SHALL
HAVE THE RIGHT OF APPEAL AS IN NOW PROVIDED UNDER THE
GENERAL LAWS OF THE STATE. WHERE THE ACT OR OMISSION IS
OF A CONTINUING NATURE AND IS PERSISTED IN, IN VIOLATION
