THEREOF, BY REPEALING SECTION 195 IN ITS ENTIRETY
AND PLACING IN LIEU THEREOF A NEW SECTION 195.

SECTION I: BE IT RESOLVED, ENACTED AND ORDAINED by
the Mayor and Board of Aldermen of the City of Frederick,
that the Charter of the City of Frederick, as the same
was enacted by the General Assembly of Maryland in
Chapter 539 of the Laws of 1951, be amended by repealing
Article XVI, Police and Fire Protection, Section 195, in
its entirety, and placing in lieu thereof the following:

ARTICLE XVI. POLICE AND FIRE PROTECTION.

SECTION 195. TENURE AND AGE LIMITS OF POLICEMEN.

(A)    ALL POLICEMEN APPOINTED UNDER THE PROVISIONS
OF THIS CHARTER SHALL HOLD THEIR RESPECTIVE OFFICES,
UNLESS DISCHARGED, RETIRED OR OTHERWISE INCAPABLE OF
SERVING, UNTIL THEY BECOME SIXTY-FIVE YEARS OLD, WHEN
THEY SHALL BE RETIRED.

(B)    NO PERSON SHALL BE ELIGIBLE FOR APPOINTMENT AS
POLICEMEN EXCEPT RESIDENTS OF THE COUNTY OF FREDERICK,
BETWEEN THE AGES OF TWENTY-ONE AND THIRTY YEARS,
INCLUSIVE, WHO HAVE BEEN RECOMMENDED BY THE POLICE
COMMISSIONERS FOR THE CITY OF FREDERICK AND THOSE WHO
WERE ACTIVE MEMBERS OF THE POLICE FORCE AT THE TIME OF
THEIR APPOINTMENT ON DECEMBER 13, 1940.

(C)    EVERY MEMBER OF THE POLICE FORCE SHALL RESIDE
WITHIN THE CORPORATE LIMITS OF THE COUNTY OF FREDERICK
AND THOSE APPOINTED TO THE FORCE WHO RESIDE ELSEWHERE
SHALL ESTABLISH THEIR RESIDENCE WITHIN THE CORPORATE
LIMITS WITHIN SIX MONTHS OF THE APPOINTMENT. THIS
SUBSECTION SHALL NOT, HOWEVER, APPLY TO THOSE MEMBERS OF
THE POLICE FORCE WHO MAINTAIN A BONA FIDE RESIDENCE
OUTSIDE THE CORPORATE LIMITS OF THE COUNTY OF FREDERICK
ON THE EFFECTIVE DATE OF THIS AMENDMENT TO THE CHARTER OF
THE CITY OF FREDERICK.

SECTION II: BE IT FURTHER RESOLVED that the date of
passage of this Resolution shall be April 4, 1974 and the
amendment to the Charter of the City of Frederick shall
become effective on May 24, 1974, unless a proper
petition for referendum herein shall be filed as provided
by Section 13 of Article 23A of the Annotated Code of
Maryland, and provided a complete and exact copy of this
Resolution shall be continuously posted in City Hall,
Frederick, Maryland, until May 24, 1974, and provided
further that a fair summary of the proposed amendment
shall be published in the News—Post, a paper of general
circulation in the City of Frederick once in each of the
weeks of April 7, 1974, April 14, 1974, April 21, 1974
and April 2 8, 1974, and that all sections or parts of
