Charter Amendment 74—1

COTTAGE CITY COMMISSIONERS OF THE TOWN OF
COTTAGE CITY, MARYLAND

A RESOLUTION AND ORDINANCE to Amend Section 17-11(a)
of the Code of Public Local Laws of Prince George's
County, Maryland, (1963 Edition), titled, "Cottage City",
and subtitled "Taxes'", and subheaded "Maximum Rate",
being a part of the Charter of Cottage City, Maryland,
and changing the authority of the Cottage City
Commissioners to have the power to increase taxes from
thirty—five cents to SIXTY cents on each $100.00 of
assessment value of real property; the elimination of tax
on personal property was changed by Charter Amendment in
1970.

SECTION 1. BE IT RESOLVED, ENACTED and ORDAINED by
the Cottage City Commissioners of the Town of Cottage
City, Maryland, that Section 17—11(a) of the Code of
Public Laws of Prince George's County, Maryland (1963
Edition), titled "Cottage City", and subtitled "Taxes",
and subheaded "Maximum Rate", being a part of the Charter
of the Town of Cottage City, Maryland, be and the same is
hereby amended to read as follows:

17—11 (a) Taxes.

(a) Maximum Rate. The Town of Cottage City and the
Cottage City Commission shall have power to levy, at the
first meeting in February of each year, taxes at the rate
of not to exceed [thirty—five] SIXTY cents on each one
hundred dollars of the assessable value of real [and
personal] property within said town for the tax year
commencing on the first of July, based on the State and
county assessments for all purposes; and all taxes so
levied shall be a lien on any and all property of the
person, firm, partnership, company, association or
corporation against whom they may be levied; and the
taxes for each year shall be payable on the first of July
next succeeding the levy thereof and shall be in arrears
and subject to legal interest and penalty from and after
the first day of October.

BE IT FURTHER RESOLVED, ENACTED and ORDAINED by the
Cottage City Commissioners of the Town of Cottage City,
Maryland, that any section or sections of the Charter of
the Town of Cottage City, Maryland, which are
inconsistent with the above enacted Section, be, and the
same are hereby repealed.
