COLLEGE PARK

existence of a Commissioner System rather than the
obsolete Magistrate System,

NOW, THEREFORE, BE IT RESOLVED by the Mayor and
Council of the City of College Park, that Article XI,
Section 30 of the Charter of the City of College Park,
entitled Police Force, is hereby repealed and reenacted
as follows, and therefore hereby repeal any section or
sections of the existing Charter which are inconsistent
with the herein amended section:

SECTION 30 - POLICE FORCE

THE MAYOR AND COUNCIL SHALL HAVE THE POWER TO
ESTABLISH AND MAINTAIN A POLICE FORCE OR TO ENGAGE THE
SERVICES OF STATE OR COUNTY CONTRACT POLICE, OR TO
REQUEST THE PRINCE GEORGE'S COUNTY POLICE TO PERFORM
POLICE DUTIES WITHIN THE CITY. WHEN SO ENGAGED, SUCH
POLICEMEN SHALL HAVE THE SAME POLICE POWERS AND AUTHORITY
WITHIN THE CITY AS ARE NOW POSSESSED BY MEMBERS OF THE
PRINCE GEORGE'S COUNTY POLICE OUTSIDE THE CORPORATE
LIMITS, INCLUDING THE POWER TO ENFORCE THE CITY'S OWN
CODE AND ORDINANCES WITHIN THE CITY'S CORPORATE LIMITS.
THE SAID POLICEMEN SHALL HAVE THE AUTHORITY AND POWER TO
TRANSPORT PERSONS ARRESTED TO A COMMISSIONER AND THENCE
TO THE NEAREST PLACE OF COMMITMENT, AS DIRECTED BY SAID
COMMISSIONER.

BE IT FURTHER RESOLVED by the Mayor and Council of
the City of College Park, Maryland, that the aforegoing
proposed amendment shall be posted at the Municipal
Building, 4500 Knox Road, College Park, Maryland, for a
period of at least forty days following its adoption and
shall further be published in the Prince George's Post
once in each of four successive weeks before the 22nd day
of December, 1974.

BE IT FURTHER RESOLVED by the Mayor and Council of
the City of College Park, Maryland, that the proposed
amendment will come and be considered part of the
municipal charter of the City of College Park on the 1st
day of January, 1975 unless a petition is filed pursuant
to Article 23A, Section 13 of the Annotated Code of
Maryland, 1957 Edition, as amended, said petition to be
filed on or before the 22nd day of December, 1974.

BE IT FURTHER RESOLVED by the Mayor and Council of
the City of College Park that the foregoing Charter
Resolution be and the same is hereby adopted this 17th
day of November, 1974.
